Yes, I agree, your point is a perfectly valid one. But the thing about which I am speechless, is the justice system which allows him to be an actor in the deaths of 24 unarmed civilians, and then make a plea bargain to plead guilty to a misdemeanour. He was answering to a charge of multiple manslaughter, and was allowed to bargain a position on 'dereliction of duty'? What sort of justice system encompasses that???
How do you know that there weren't extenuating circumstances which mitigated the original charges? The Marines were attacked from the direction of the building occupied by the victims. The Marines were responding to a combat situation. Intent must be proven beyond a reasonable doubt and in this case it could not be proven.
What a load of horse puckey, it is indisputable that the marines murdered the civilians in cold blood as they moved from house to house. There is zero evidence hostile fire was coming form the direction of the murdered civilians, it was revenge killings. Thats what makes this crime even more heinous. U.S. soldiers tortured captive prisoners to death in their Abu Ghraib dungeon yet NOBODY was ever even charged with murder let alone sentenced for those homicides. I can't' imagine why anyone expected different in this case. If you can torture chained up people to death and get away with it then you certainly needn't worry about consequences for shooting unarmed people at point blank on the "battlefield".
True and his punishment does fit the crime which he was convicted of. But we know what he did, he knows what he did, and as far as I am concerned he should not be allowed to see the light of day ever again.
He's been sentenced to the maximum punishment allowable for dereliction of duty. That is the only offense that he was convicted of, otherwise he's presumed innocent of any other crimes.
