If you look at "gun control" state by state, the pro 2A states are winning. If you look at it on a population basis however, the anti 2A are more numerous. As of right now it is simply a States' Rights issue. The various states still have the power to free or enslave their own residents. That's fine with me since I live in a pro-gun state of a pro-gun region. The anti-gun regions are the northeast and California.
With DJ Trump and the McConnell Senate likely to seat 3 to 4 more SCOTUS justices (Gorsuch being already seated now), the Court will be pro-2A for decades to come. That's a very good thing. The Nuke Option has already been implemented for the SCOTUS nominations and there is nothing that the DEM's can do to stop this before 2019. That's also a very good thing. God loves America !! God loves guns !!
I don't see Gorsuch being specifically 2A, but rendering opinions with a near Originalist examination of any issue and given that, any rational interpretation of the 2A will prevail in preserving the rights it protects. Then too, it is likely, Trump will be submitting candidates for other federal judges in the next few years and like another to SCOTUS. The primary objective should be selecting candidates that will restore the check and balance system where the Legislature, not the Courts, legislate.
Gorsuch and Kagan are both untested on 2A. I am guessing Gorsuch will be pro-strict constructionist and that Kagan will be activist. We'll need to wait and see. Kennedy will probably retire and Roberts will probably be viewed as a swing voter on most issues. Roberts was pro ACA but anti Same Sex Marriage.
2A is very vague unfortunately. It did not successfully address the submachine gun issue of the 1920's. Some people feel it does not address the assault carbine issue of the 21st Century either. The handgun issue has presumably been settled by Scalia (RIP) in Heller. People now have a right to own their own handguns in their homes and keep them ready to fire in their homes. I don't see the Roberts Court overturning Heller ever. State regulation of public firearms possession (carry) is not clear yet under either Heller or under 2A. My state is a shall-issue state so I am happy. We have reciprocity in all the other western states except Calif, Ore, and NM. So it works for me. I just avoid Calif, Ore, and NM. Problem solved.
scalia knew that the several states had that police power. He also was unwilling to overturn the atrocious expansions of the commerce clause. two of his former clerks have stated he threw in that language to get Kennedy to join the majority since Kennedy is wishy washy on most issues. There is no evidence that Scalia believed in federal gun bans or restrictions that apply to those with clean records
Face it. I would like to hear of just one judge at the SCOTUS or federal bench level that does not believe in gun control. They must be all ivory tower men. LOL
that's a bogus argument. you would have to delineate the fraudulent commerce clause based gun control vs the far more legitimate state power to limit the use of firearms in say municipal areas. I suspect 99% of all gun owners support a city ordinance that would prohibit shooting skeet on times square or no firing of Barret 50 caliber long range rifles in Central park
