In many of these surrogacy cases, it's a low-income woman who was paid up front, and most often she has already spent the money. So if she abrogates the contract, she has to pay back $50,000 which she doesn't have, and the ones hiring her will no longer pay for her medical expenses (which can sometimes be very substantial). If she can't pay back the $50,000 she could go to jail. So she may have to face the choice of either aborting her pregnancy she doesn't want to abort, or potentially serving jail time. For many low-income women there's no way they could pay back that much money, and they very likely spent it all already because many of the women who become surrogates do so because they needed to come up with quick cash to be able to pay expenses. Heck, if the woman breaks the contract she might have to get pregnant for another couple (again!) to pay back the advance she took.
quoting hoosier88: 1. Is this an enforceable contract? It seems to me that any US judge would throw it out, as containing unenforceable terms. Has any contract containing these terms ever been enforced in the US, as far as the surrogate only carrying one fetus (out of more than one) to term? The question stands. I'm aware of what makes up a contract - the key question - if someone hires a surrogate to carry a fetus to term, can the hiring party require twin (or however many fetus) reduction surgery? Is that an enforceable provision? Given the disparities in power & position between the contracting parties, I tend to think that the court would overrule any provision that the contracted vessel found morally repulsive. No, I don't believe the surrogate owns the fetus(es) - although possession is supposed to be nine tenths of the law, as the saying goes. I assume that the contract stipulates that the fetus(es) belong(s) to the hiring party.
Sell the spare to a gay couple. That one will have a better life than with the cheapskate straight couple anyway.
So, you think she should have a reduction? I am saying that she should do what she wants to do, but that the bio parents do not have to take a second child that they did not contract for.
I believe in contracts. I am not whom suggested this "reduction." I shake in terror my past two wives would have told me they wanted a reduction. I have two lovely daughters and am super proud of both. I see the unborn as the future. I see them as humans in the making. I see a major moral problem with the millions of them killed annually. It is as if they think of them as a dozen eggs and might be willing to cook them and eat them.
My sister married a homosexual and they had 5 kids in all. But when the girls grew up, he divorced her so he could swallow some man juices.
What has any of that got to do with the post of Zeffy's that you quoted? ....and did you notice how YOU got PERSONAL.....
Dreaming? Or just being vulgar? Talk like that around your daughters?? ...and , of course, it had NOTHING to do with the post you quoted: ""Sell the spare to a gay couple. That one will have a better life than with the cheapskate straight couple anyway."""
I suspect that a lot of this depends on which state the parties live in. I can't dispute a judge tossing out the terms and trying to force the party desiring the child to take both. I just am not sure. It would be highly risky to contract for a child without using attorney's services.
LOL, I can always tell when you know you've been caught and haven't anything to say....you post it anyway.....who was posts 30 and 31 about if not YOU ?
He is long since dead. By the way, thanks for making my family your business. At my age, just what I need is a lecture from a person who does not know the homosexual nor the damage he did to his own family.
You keep trying to make it about me. I know you truly want this to be all about you. We will try to make it about you.
I didn't make your family my business. YOU are the one who brought him into the discussion. Hope you don't tell your nieces/nephews by him that they shouldn't be alive.
Oh WOW you discovered this isn't about you and your family!!! Good now maybe you'll discuss the topic !!!
It would be up to the pregnant mother. Its her body. The majority of parents willing to adopt are white, while white children being adopted are a minority. My question to you is why you claim to care about these lives when you take no action. You could save a life if you really wanted to. This question will never go away.
YOU put it out here. If you didn't want it commented on, you shouldn't have posted it. I'd like to tell you what to do with your homophobia, but forum rules prohibit me from doing so.
Homo phobia means fear of homosexuals. Show me what I said to cause you to accuse me of fearing homosexuals? I did not mention it to get taunted nor insulted.
