American forces were guest of the Saigon government and came under South Vietnam laws. American troops could be indicted and prosecuted by the South Vietnamese government but would be tried in a U.S. military court. American troops had to obey South Vietnam's traffic laws. If an American driver of a 6X or a jeep got into a traffic collision the Vietnamese police would show up. I remember when we were returning from the Freedom Hill PX headed back to Hill 55 when a Vietnamese on a scooter T-boned the 6X we were in. We had to stop and wait for the Vietnamese cops. The driver was a cherry a FNG who had only been in-country for a few weeks. He was kinda shook up and extremely nervous. I told the young PFC "Hey, you probably got your first confirmed kill. The dead gook was likely VC and he wont be around tonight firing an RPG at you while your on perimitter watch." Around DaNang it was VC and most of the civilians in and around DaNang were VC. Most of the villages and hamlets in the DaNang area were farmers by day and at night the men young and old and the women and even children were VC at night.
The U.S. military didn't lose the war, the war was lost on the streets of America by the useful idiots of the Kremlin and by the Democrats in Congress. After the major defeat of the NVA and VC during the Tet Offense of 68 Gen. Giap and Uncle Ho were seriously considering a conditional surrender. This is when Gen. Giap said that the American soldier couldn't be defeated on the battlefield. Then Walter Cronkite on television lied to the American people about Tet and they started paying attention to the anti war movement on the streets of America and came up with a new stategy that they could win the war on the streets of America. The new strategy was no longer taking and holding ground but a war of attrition. Keep the war going until the American people got tired of the war. Cross over into South Vietnam and kill as many American soldiers as possible and then run back across the border into their sanctuaries in Laos and Cambodia. The SDS, VVAW, liberals and the press would take care of the rest in America.

The same is true of many colonial wars. If you leave and the side you were fighting takes over you lost. For example, Britain did not lose in Malaya because it defeated the Communists before withdrawing. France lost in Algeria despite militarily crushing the FLN because it left them in a position to take over when it left. The problem with this sort of speculation is that it becomes a haven for those who cannot tolerate an uncomfortable reality. Well that would at least be a step in the right direction, though the people who are wedded to the idea of 'no defeat' seem very emotionally attached to it. Hindsight isn't always the best way to assess the value of a particular action. When America committed to Vietnam in 1965 it was not yet clear what the outcome in Indonesia would be. The mass murder of Communists didn't finish until 1966 and Sukarno wasn't removed until 1968. By that time America had already committed 500,000 troops to Vietnam and was looking for a way out. It was also not clear what the fallout of a Communist victory in Indochina would be. Thailand and Malaysia still had active Communist insurgencies. China was seen as a serious threat to the region & not without reason. America didn't have to commit to Vietnam as it did, but there were compelling reasons to do so. The actual loss of Vietnam didn't have a great impact on America. Certainly nowhere near the impact fighting the war did. The impact on Indochina was a different matter, however. Cambodia had been doomed since 1971 but the Khmer Rouge had been held back by a combination of US bombing & Chinese pressure (China was worried collapse there might spur the US to get back into the region). Laos was similarly ripe to fall once Vietnam resolved. Both nations suffered considerably, as did the former South Vietnam (though the suffering wasn't as great as some of the exaggerated figures pushed here). No one foresaw the collapse of the Shah. Not in the US, not even in Iran. There are a lot of things the US could & should have been doing in that period, starting with cutting support for Yayah Khan the moment it became clear the Pakistan army was committing mass murder in East Pakistan & followed by leaning on Suharto not to invade and murder a third of the population of East Timor. The Shah, however, was a tricky one. He was seen as a positive force - a modernising US ally in an important region prone to Soviet influence.
