Trump might be completely losing it now. Here's his latest Tweet: He's proposing execution for hate crimes. That means assault, robbery or other crime motivated by hate against a protected class of people (religious, gender, sexual orientation etc) would result in the death penalty. That's just plain insane. The second part of his proposal is another example of his ignorance of the law and the 5th and 14th Amendment Constitutional protections of rights like Due Process.
I say we should turn the El Paso shooter over to Mexico as they have requested as 7 of his victims were Mexican citizens.They will try him and execute him much quicker than us, and it won't cost tax payers millions for endless appeals.

He's an idiot. But he does take this risk. A duel partisan strand in both liberal and conservative circles still thinks of hate crime designation as an aggravating factor in sentencing represents 'criminalizing thought'. He's going to tick off some allies, including many white supremists. But the practical impact of this proposal on anyone's conduct from the perpetrators, to the DA's office, to jurors to appellate courts, to the ACLU will be virtually nothing. These mass shooters are barely giving any thought to what will happen in the criminal justice system, after they stand around and mow down 15 people. They are not planning on escaping justice at all. Many just assume they will kill themselves or be killed by cops. This proposal might impact a couple of 'co-conspirators' or people charged with 'aiding and abetting' behind the scenes, but I doubt it.

Most people don't consider robbery and assault a hate crime deserving of the death penalty, and that is not what he is suggesting either. This guy could be given his full due process and executed within a year. Give him a trial, give him his shot at appeal, then kill him. No reason to drag this out for 20 years. Only problem though is I don't believe death is a deterrent for most of the killers. Most of them kill themselves or have to be killed during the act.
