It's California! There are plenty of addiction treatment and prenatal programs for drug addict women who are pregnant! They're not really (so much) punishing her for being an a drug addict, they're punishing her because an 8-month gestation unborn baby died. Your argument might hold more water in almost any other state, but not California!
If it is a crime in the state of California, then obviously the liberal politicians in the state of California do not see the so-called "war on drugs" as being moronic, as they are continuing it freely of their own volition.
Is it even known to yourself why addiction is being regarded as a disease, rather than a personal choice? It is due to the fact that there is greater funding to be had in providing a "treatment" to a so-called disease, rather than writing the behavior off as a crime that can only be punished. The medical industry experiences direct financial benefit by perpetuating the myth that addiction is a disease and that addicts are nothing more than helpless victims. In doing so, the medical industry can freely, legally market and distribute its own opioid substances in the form of methadone to addicts, taking business away from illicit dealers by offering a legal alternative.
Addiction is not a disease, but rather it is a scam meant to be utilized to exploit others for personal and monetary gain. If there was no financial gain to be had by the medical industry, addiction would still be regarded as a choice.
The distribution of substances such as methadone, and the existence of methadone clinics all over the united states, is evidence and proof that the position is factually correct. Methadone is classified as an opioid, no different than cocaine or heroin, yet because it is being presented as a supposed "cure" and "treatment" to addiction, it is legal to distribute, and the medical industry receives financial gain. The medical industry does not care about the wellbeing of those who are addicted. It only cares about its own financial gain, and is exploiting their position to go about obtaining it.
it's called population control... make laws that every pregnancy gone wrong is the mother's fault and lock them up... in short order, billions of women will decide not to bear children out of fear... population decreases to manageable numbers, all accomplished without disease nor warfare...

She had a stillborn baby. Now she’s being charged with murder. This is one good example for why we must NEVER make all abortions illegal. Miscarriage or stillborn birth are nature's way to end unsuccessful pregnancies before birth. They are not controlled by the mother, but by mother nature. The danger here is from anti-abortion fanatics who are willing to punish innocent pregnant victims for alleged criminal actions that they have no control over & no say in happening. This is the kind of injustice we can all expect from laws written & passed by extremist fanatics involved in any issue.
The death was caused due to use of an illicit narcotic substance. It has nothing to do with the fact that the death in question pertained to an infant.
Yep, that's what I've been trying to say. We all know that California loves abortions, and has very liberal attitudes about drug use (probably the most liberal in the entire country). If this woman is getting punished in that state, what she did must have been very bad. And indeed it was.
An update on the story: The California Supreme Court declined Wednesday to stop the murder prosecution of a woman whose fetus was stillborn after using meth. In doing so, the court rejected a rare challenge by California Attorney General Xavier Becerra. Chelsea Becker of Hanford has been in jail since the September 2019 stillbirth. Police say methamphetamine was found in the fetus and that Becker, who was 8 1/2 months pregnant at the time of the stillbirth, had admitted recently using the drug. Philip Esbenshade, executive assistant to Kings County District Attorney Keith Fagundes, said the law authorizes a murder charge for "the reckless or indifferent unlawful conduct of a mother that results in the unlawful death of her fetus." “This is not a case about abortion nor women’s reproductive rights,” he said in a statement to the Chronicle. “This is a case about a person who did specific acts that resulted in the death of a viable fetus.” A 1970 California law allowing murder prosecution for intentionally or recklessly causing the death of a fetus does not say whether the pregnant woman herself can be charged. However, it lists circumstances that would bar prosecution, including legal abortion, medical intervention to save the woman’s life, or any act that was "solicited, aided, abetted or consented to by the mother of the fetus."
