They were already paying the premiums (or penalty) by mandate. It was the co-pays and deductibles they could not afford, so they didn't use the insurance.

The person will have to find the means to pay for it themselves if the treatment is deemed necessary. I've done it multiple times, and actually, a number of non-invasive treatments are less expensive if one arranges to pay cash, even on a payment plan. Most hospitals will take payment plans, at reduced rates. Some doctors, but I have yet to find a pharmacy to take payment plans. Insurance is a front loaded payment mechanism that collects money regardless if you use it or not. A better way to help those who need health care is to pay for it at the time of service, because they are actually receiving the care.
