Sorry... no link yet.... breaking news on MSNBC (title is the screen graphic) I will post one when I see one... The few bits they posted on the TeeVee seem like a major rebuke of Judge Loose Cannon.... not sure if she has been removed from the case as well, which I understand was an option. I personally had no issue with the SM, feeling that he and the DOJ would have been in agreement on almost everything, but it was just additional unnecessary delay, as facilitated by the Loose one This should mean all documents are available to the DOJ, and the process can continue at their normal glacial pace... Thoughts?
Paywalled WAPO, but you can read in Incognito https://www.washingtonpost.com/national-security/2022/12/01/trump-cannon-special-master-rejected/ EDIT - I love that the WAPO puts this in their "national-security" folder, since this is one of the worst national-security situations of the past 5 years, minimum...
Don't forget what Delusional Black Moron handles issues coming out of the 11th circuit.... Setting up yet another probable loss.... If Donald Trump were playing in the World Cup, he would have been eliminated after the 1st half of the 1st game.... LOO-SER EDIT - I had an interesting thought... is the DOJ allowed to appeal their own win to the SCOTUS? They probably should consider doing that, just to keep the wheels moving, instead of waiting for Mango to do it...
I think we need to offer our condolences and consider a GoFundMe for former Special Master Judge Dearie... He was all set to milk Trump for thousands of bucks for simply saying "Personal" or "Not Personal".. Damn good work if you can find it... It's always possible there will be another Trump case actually requiring a special master.... We'll keep him on speed dial...
You can usually find a non paywalled reprint @ www.yahoo.com so check there. I think it's about time. Trump has been jerking everyone's chain with this dog and pony which is just a ruse to delay, delay, delay. https://www.nytimes.com/2022/12/01/us/politics/trump-special-master.html
NYTs article https://archive.ph/cmyxQ So much for judge shopping, eh? No invite now for Cannon at Trump's New Years Eve bash at Mar a Lago. Trump Went Judge Shopping and It Paid Off in Mar-a-Lago Case https://www.thedailybeast.com › donald-trump-went-ju... Sep 6, 2022 — Trump got the judge he wanted in the Mar-a-Lago case: One he appointed. And she just gave him the first decision he wanted. Snip: "When former President Donald Trump summoned up years of bubbling resentment and sued Hillary Clinton and everyone else involved in Russiagate earlier this year, he naturally filed his lawsuit in South Florida—home to his oceanside estate. And yet, when his attorneys formally filed the paperwork, they selected a tiny courthouse in the sprawling federal court district’s furthest northeast corner—a satellite location that’s 70 miles from Mar-a-Lago. They ignored the West Palm Beach federal courthouse that’s a 12-minute drive away."
Effectively, the special master wasn't going to abide by the original ruling to begin with. And it seems as though the judiciary has agreed with the prosecution in whole in this case. Which again, to me is a sad direction for the judiciary. If the judiciary in whole, agrees with the government then the judiciary is incapable of being an impartial overseer of any criminal trial of any client. Basically, the judiciary is and probably always has been, the government's lap dog. So much for that checks and balances thing in that regards. The only thing that stops judiciary-government abuse, is the will not to abuse. That's not very assuring.
Trump would not use him again, because he had been trying to expedite the process, as far as I am aware.
Judge Cannon is smart and playing the long game. Even though it has been revealed she is unprincipled, she will be at the top of the list if GOP gets a chance to make a SCOTUS nomination.
So let's consider the district opinion here: The only legitimate time to challenge the claim of evidence is during a criminal indictment by the State/Government. Were I Trump's lawyer, I would follow up simply with: Where is said indictment? Government claimed in its search warrant pursuant to 3 criminal statues, furthermore the government and the court agrees with this argument. If the government's argument is that the defense is 'stalling', then the defense can argue just as well that every day that the government doesn't file an indictment, by their and the court's own arguments is the very definition of stalling. So the defense is left to wait in the indefinite loop of time, while the government takes its sweet time quote/unquote 'deliberating' on whether or not to try the client, then and ONLY then can the defense contest the government's evidence? Absurd.
Judges invent rules all of the time in virtually every case. That quite literally is the power of the gavel.
Inventing rules? No. Judiciary relies on case law and precedence. Doesn't matter who the defendant . A judge interprets the law, they don't invent them.
Judge Cannon has just had her judgment demolished on appeal, which is a stain on her record. When our judgments are overturned - in a self-respecting state of law - we don't become SCOTUS judges.
With respect, you have that arze about! The Appeals Court has just done what you want....ie....told 'Judge' Cannon she had no right interfering. That is...the Court just told the judiciary to butt out of investigations, even of a former POTUS. That is what you want, yes?
Nah, again you have it arze about. Humpty is the bloke directly responsible for delay. He caused the investigation to be (illegally) paused, thus delaying the DOJ's ability to come to a conclusion on whether to indict. Now that road block has been removed the DOJ can consider the documents found in Humpty's possession all those many months ago.
Well, she did the job she was hired to do... she got nearly 2 full months of delay, so don't discount her invite just yet... I expect the Pro Quo to come in at some point... I hope it's more than an evening at MAL
Let's all agree that at the very least, this scenario WILL be scrutinized should she ever be up for a higher court....
...--without any regard at all for the issue, the subject, the charges, the known history? Pretty shallow knee-jerk it seems. Tell me AN, why do you have this opinion suddenly now after all these years?
To republicans, she was defending the chose one. They won't see it as a stain, but rather a badge of honor.
So now the examination of all the documents recovered in the search of Mar a lago can proceed unfettered ? And the case against the Orange Stain can proceed?
I just don't think the judiciary's position of "welp, we should defer all things to the government" is good for anyone involved. Like, these rulings deal with the Trump case, but it goes beyond the trump case. We literally have no reason to believe the judiciary isn't going to be buddy buddy with the government. The DOJ was designed for that, but as recent cases have shown that's no longer the case. The idea of an independent judiciary and the nexus between the judiciary and the government are legitimately at question.
