So then did Bush and virtually every other president for the last 220 years. The court narrowed the definition of Recess to the period between the annual sessions of Congress. John Bolten's appointment as Ambassador to the U.N. was under this definition also unconstitutional. From now on a minority party can hold up almost all appointments that require Senatorial approval leaving a president unable to fill, even temporarily cabinet position's, judgeship's and other position's. From now on Democrats can block all choices of Republicans and Republicans can block all choices for Democrats. Great day for America.
I wonder if anyone could answer me this? Isn't Obama supposed to be a Constitutional Scholar? At least that was what the President claimed. Obama was supposed to be a Professor of Constitutional Law, Right? Well, at least that was what Obama claimed even if it was later proven to be a gross exaggeration. So if any of Obama's biography is actually true, how could he have bungled this so badly? He lost 0 to 3 at the DC circuit court, the second most liberal court in the land. He not only lost but he was spanked. How is that possible when a background in Constitutional Law was his one and only real qualification for office? Was it all a lie?
Sorry, most constitutional scholars that have spoken out on today's decision are saying it went much too far. We'll see what the SCOTUS has to say.
Seeing as Obama most likely has Roberts in his pocket now, we'll see how the SCOTUS rules when it gets there. They've been wrong on many decisions over the years since they voted themselves the final word on interpreting the Constitution.
Good question. Another question would be why doesn't every member of the supreme court vote the same way on every case?

And what about the over 200 regulation inacted by this illegal power grab by Obama/Reid. Are any regulation inacted under the illegal appointment of Nominees that had to go thru Advie & Consent and made null & void. Because it's illegal to have a 3 person board with only 2 person.
They'll take it up before a year for sure, especially with the publicity and being it involves the president.
Because the Constitution is not as clear cut as some seem to think it is. Over our history, there have only been a very few court decisions that have been decided unanimously.

PLease cite the federal ruling that HOW Bush appointed cabinetand other positions was "unConstitutional", or stop the asinine "it's the same" bullcrap. There are specific parameters under which recess appointments can be made, but thayt is only PART OF OBAMA'S ABUSE. I think you are wrong. Let me ask a question, in say 1820, could a State limit freedom of speech if it's own state Constitution did not guarantee it? Was it Constitutional for the Southern States to outlaw the sale or possession of the book Uncle Tom's Cabin in 1855?
