IRS official testifies: Obama political appointee's involved in Tea Party Attack

A veteran IRS worker testified on Thursday that officials from a Washington office led by a political appointee intervened in the screening of Tea Party applications, saying publicly for the first time the IRS chief counsel's office was involved in the controversial program.

Carter Hull, a recently retired tax law specialist, gave his first-hand account during testimony before the House Oversight and Government Reform Committee.

Hull had earlier come under scrutiny after an employee in the Cincinnati IRS office told congressional investigators that he had been micro-managing her review of Tea Party groups' applications for tax-exempt status. But Hull revealed that he, too, was taking orders from up the chain of command.

Hull specifically said he was told to forward documents to an adviser for embattled IRS official Lois Lerner -- who first revealed the targeting of Tea Party groups and has since refused to answer lawmakers' questions. But Hull said he was then told to send documents to the Office of Chief Counsel for their review -- which is led by political appointee William Wilkins.

At an August 2011 meeting, Hull said, someone from the chief counsel's office said additional information was needed from Tea Party applicants that Hull was dealing with, and that a second letter should be sent out requesting more information.

These letters have since been cited by Tea Party groups as part of a drawn-out process that in some cases left them without any resolution for years.

Yeah... Hoffacre didn't take well to being blamed for this mess.

“I was deeply offended,” Hofacre said of the “rogue” allegations. “I mean, it impugned my reputation and the reputation of other agents and, basically, all federal employees.”

Asked again, she added, “Personally, I feel it was like a nuclear strike. They were blaming us.”

Hofacre said IRS employees had reached out to Washington for guidance in 2010 on how to proceed with tea party cases and were told to wait. She was handling these cases from April to October 2010, shortly before crucial midterm congressional elections. She eventually requested a transfer because of her mounting frustration over the delays and lack of guidance.

But who is William Wilkins? According to the 2009 announcement of his appointment to the IRS, Wilkins was a registered lobbyist with Wilmer Cutler Pickering Hale and Dorr since 1988. At WilmerHale (the firm's new name after 2003), he was a part of the Tax Practice Group, where he practiced a wide range of tax law services, including “counseling nonprofit organizations, business entities, and investment funds on tax compliance, business transactions, and government investigations.” Before his lobbying career, Wilkins was staff counsel for the Democratic side of the Senate Finance committee, from 1981 to 1988.

Wilkins' longtime employer has served as a recruiting ground of sorts for the Obama administration. Other WilmerHale alumni currently serving in the government include Assistant Treasury Secretary for Terrorist Financing David Cohen and Special Envoy for Climate Change Todd Stern.

The close ties between the White House and WilmerHale can also be seen in the short-lived tenure of David Ogden as deputy attorney general.

According to the election records available on CQ's MoneyLine Web site, Wilkins has made at least $35,000 worth of political contributions over the years. He has donated to a number of prominent Democrats, including five donations totaling $4,250 to Sen. Max Baucus (D-Mont.), chairman of the Senate Finance Committee.

The Senate Finance Committee has jurisdiction over revenue matters, and the Committee is responsible for conducting oversight of the administration of the federal tax system, including matters involving tax-exempt organizations. The Committee has focused extensively over the past decade on whether tax–exempt groups have been used for lobbying or other financial or political gain.

The central question examined by the Committee has been whether certain charitable or social welfare organizations qualify for the tax-exempt status provided under the Internal Revenue Code.

Recent media reports on various 501(c)(4) organizations engaged in political activity have raised serious questions about whether such organizations are operating in compliance with the Internal Revenue Code.

The law requires that political campaign activity by a 501(c)(4), (c)(5) or (c)(6) entity must not be the primary purpose of the organization.

If it is determined the primary purpose of the 501(c)(4), (c)(5) and (c)(6) organization is political campaign activity the tax exemption for that nonprofit can be terminated.

Even if political campaign activity is not the primary purpose of a 501(c)(4), (c)(5), and (c)(6) organization, it must notify its members of the portion of dues paid due to political activity or pay a proxy tax under Section 6033(e).

Also, tax-exempt organizations and their donors must not engage in private inurement or excess benefit transactions. These rules prevent private individuals or groups from using tax-exempt organizations to benefit their private interests or to profit from the tax-exempt organization’s activities.

A September 23 New York Times article entitled “Hidden Under a Tax-Exempt Cloak, Private Dollars Flow” described the activities of the organization Americans for Job Security. An Alaska Public Office Commission investigation revealed that AJS, organized as an entity to promote social welfare under 501(c)(6), fought development in Alaska at the behest of a “local financier who paid for most of the referendum campaign.” The Commission report said that “Americans for Job Security has no other purpose other than to cover money trails all over the country.” The article also noted that “membership dues and assessments ... plunged to zero before rising to $12.2 million for the presidential race.”

A September 16 Time Magazine article examined the activities of Washington D.C. based 501(c)(4) groups planning a “$300 million … spending blitz” in the 2010 elections. The article describes a group transforming itself into a nonprofit under 501(c)(4) of the tax code, ensuring that they would not have to “publically disclose any information about its donors.”

These media reports raise a basic question: Is the tax code being used to eliminate transparency in the funding of our elections – elections that are the constitutional bedrock of our democracy? They also raise concerns about whether the tax benefits of nonprofits are being used to advance private interests.

With hundreds of millions of dollars being spent in election contests by tax-exempt entities, it is time to take a fresh look at current practices and how they comport with the Internal Revenue Code’s rules for nonprofits.

I request that you and your agency survey major 501(c)(4), (c)(5) and (c)(6) organizations involved in political campaign activity to examine whether they are operated for the organization’s intended tax exempt purpose and to ensure that political campaign activity is not the organization’s primary activity. Specifically you should examine if these political activities reach a primary purpose level – the standard imposed by the federal tax code – and if they do not, whether the organization is complying with the notice or proxy tax requirements of Section 6033(e). I also request that you or your agency survey major 501(c)(4), (c)(5), and (c)(6) organizations to determine whether they are acting as conduits for major donors advancing their own private interests regarding legislation or political campaigns, or are providing major donors with excess benefits.

Possible violation of tax laws should be identified as you conduct this study.

Please report back to the Finance Committee as soon as possible with your findings and recommended actions regarding this matter.

Based on your report I plan to ask the Committee to open its own investigation and/or to take appropriate legislative action.

IRS inspector general J. Russell George is one of the few people to emerge from the agency’s scandal looking good thanks to his just-the-facts report on the controversial practice of targeting conservative groups.

Until now.

House Oversight and Government Reform Committee Chairman Darrell Issa slammed George on Wednesday for not alerting Congress to the targeting of conservative groups earlier. It’s the toughest swing anyone has taken at George over the course of three congressional hearings probing the IRS scandal.

“Despite numerous requests from the committee for information and updates, including an Aug. 3 letter, the request for the inspector general to inform Congress about serious problem … the inspector general failed to do that,” the California Republican said at the hearing today.

“You have a responsibility to keep us continually, and according to statue, equally informed,” Issa said. “In this case, it appears you did not. Would you agree with that?”

“No actually,” George answered, explaining that he should not brief Congress until all the information had been analyzed and a solid, correct conclusion has been made.

But Issa said, “That is not the statute.”

George also raised concerns that incremental information provided to lawmakers would ultimately leak to the public.

“That is not fair to the people we are investigating,” George said.

Issa responded that the White House is the source of plenty of leaks as well.

Meanwhile, Rep. Stephen Lynch warned IRS officials that a special prosecutor might be named if the IRS keeps “stonewalling” investigations.

“There will be hell to pay,” he said.

Again, if this was any other crime....and someone was on record joking about said crime long beforehand...they'd be an obvious suspect. Theres his mindset in video, but we're supposed to believe this ever growing chain of people is going to magically stop at his doorstep, and he knew nothing about it.

Wilkins' donations also have been Democratic, outside of the contributions he made to a law firm's political action committee. He was an early Obama supporter, giving $250 to the future president in 2003. During the 2012, 2010, and 2008 election cycles, Wilkins donated a little less than $9,900 to parties, candidates and PACs. Democratic candidates received $7,350 of Wilkins' donations, with $4,600 of that money given in support of Obama. He also gave more than $2,500 to the PAC of Venable LLP, which contributes to both Democrats and Republicans.

Wilkins is a United States District Court Judge for the District of Columbia, a position he has held since December 2010. His experience in the public sector also includes clerking for Judge Earl B. Gilliam of the United States District Court for the Southern District of California and working for the Public Defender Service in Washington, D.C. In addition, he played a key role on the Presidential Commission that advised President George W. Bush on the creation of the National Museum of African American History and Culture, which is slated to open in 2015 on the national mall.

From 2002 to 2010, Wilkins was a trial and appellate lawyer at Venable.

Both Venable and Millett's firm, Akin Gump, have significant lobbying practices, though neither of the nominees has been a lobbyist. While Wilkins was employed at Venable, the firm earned just shy of 74.7 million in lobbying income. Akin Gump earned more than $204 million in lobbying receipts from 2007 to 2012, and $7.97 million during the first quarter of 2013 alone.

I've always found the liberal mentality quite..... puzzling.

The congressional hearing is nationally televised for whomever wants to watch it, but only Fox has chosen to show it. If MSNBC chose to show it, would the lib viewers believe they're watching the real thing? Bet they would b/c it was on MSNBC..... but then if they flipped the channel over to Fox and saw the same exact congressional hearing, same players...... well, I imagine the libs would become very confused.

Oh well! As you said 'no common sense'........

No. Seriously now, everyone should watch Fox, and one other reputable source from the left- like one of the ones you mention. That way, they'd get some good right news and some good left news. Just not MSNBC. They are TOO slanted.

The funny thing is, these liberal posters run in here and scream what a cheat Fox is, when all the posters are doing is getting that from their leftwing sources. And if liberals DO watch Fox, the watch it with such dark blinders, the Fox message is entirely distorted by their liberal blinders and again, they hate Fox with no real idea of what Fox is.
