Certainly that is ridiculous and farcical if they aren't a citizen but the child of an illegal alien born in the US is.

Currently American Samoans are recognized as American nationals; they have US passports, but not US citizens. Yet another reason (among the several other mentioned in this thread) that I don't think that the text of the 14th Amendment requires automatic citizenship for the children of illegals.

 

Then that would mean we will have already taken over the world, and it won't matter, because the whole world will be "America"

I actually have enough confidence in the Supreme Court to be fairly certain that it will uphold birthright citizenship. I believe that even the members appointed by Republican presidents will do so because the wording of the 14th amendment is very clear. Since the US has always followed the law of the soil, it also wasn't a change in the law that existed at the time (186 as far as children born in US of immigrant parents (legal or not).

Does anyone understand this amendment was written to the children of slaves who definitely were under the jurisdiction of the United States.There was a fear that they would be deported because their parents would be declared 'non-citizens". It in no way should apply to foreign nationals.

 

Do we know that for sure? Obviously the government doesn't see it that way, given that they hand citizenship to everyone who is born in the country.

 

We have a lot of slick leftist lawyers and a 9th circuit leftist court that is over ruled in a majority of cases when it is appealed. They all know the history. They are just dishonest.
