My point is the French are stricter than us when it comes to holding a person without charging them.

The French have very stricy 'anti-terror' legislation, even more inflexible than the American one in some points. Villepin has had quite some Imams deported. Yet, the French are probably still labeled as soft on 'terror'.
The Guantanamo detainees AFAIK have no proper legal status whatsoever, allowing for their eternal detention is so wished.
