In order to know whether what they were doing was a felony, we would need to know the criteria for determining it. For example, the drug seller was calling and actively attempting to sell. The fact that he had no drugs on him may not matter in Mass, but maybe it does in Florida. If you are caught with a bundle of drugs, you can be convicted of intent to sell. But intent to
purchase laws may be drastically different.
