Punish those who obey illegal orders.
Since this confinement of people without trial or recognition as prisoners of war are an international crime, I suggest that ANY person that takes part of this confinement should be considered as a criminal. Just imagine what would happen if a soldier got arrested for the crime of serving on the Guantanamo bay base, this would serve them right.
I also suggest an new international law that states that whenever someone use the classical "I just obeyed orders" defense, then their punishment should be multiplied by an factor of 5 or more, just because of that. Hopefully this will lead to a situating when people will actually start to disobey illegal orders.
Imagine this in Guantanamo:
Officer: -Guard these prisoners.
Soldier: -Sir no sir!! -These prisoners are kept here illegally, if I guard them I would become a criminal myself as you already are by issuing me these illegal orders. I am sorry sir but I must refuse!!!
I want it to become really expensive to commit the mistake of obeying the wrong orders.
