I understand what you mean. Rape is a monkey wrench in the gears of our justice system, nearly impossible to prove or disprove, often leading to a clear advantage for disprove, as this is how our system works. But it is the most fair way to run a system. I don't know what to think, but it seems the evidence really does favor the defendents. I wonder about the possibility of another white man that could have done it and the victim only seeing a white man unclearly, getting screwed up when pointing out a person... perhaps even based on prejudices of her own... but not really dishonest. As a result, I don't think anyone can seriously be prosecuted for any reason in this case.
Rape almost always comes down to word against word, and I do tend to think that the woman is less likely lying than the man, considering that taking rape to court usually just leads to the humiliation of the woman- often enough as to act as a deterrent from bringing the case up.
But in a case where we're not sure if the woman was raped and if she was, she doesn't seem to really know by whom. I agree mostly with your assessment of fratboys, but the danger of such stereotypes is that they make us condemn the innocent with the guilty. But the scary thing about fratboys is their group loyalty and power over campuses that makes them excel at cover-ups- look at all the hazing cases. The world will be a better place when people quit joining these rotten relics and let them rust in the junkyards of history.
But all in all, I admit that I have no idea.
What I can say is that our justice system is not well-suited to prosecuting things like rape and yet it would be terrible to alter the justice system in favor of prosecution. The only way to stop rape is for us to destroy the culture that supports it, destroy the culture that keeps it secret, and to begin socially ostracizing those who take part in such behavior when we catch them, rather than continuing our current culture of blaming victims.
It's not something that can be done in our court system, so I think the best way to do it is end the secrecy that keeps it alive. And quit pretending it doesn't happen by drawing on high-profile hoax cases for our inspiration when the average rape is actually some girl you'll never hear about because she never goes to the police because she knows our court system can't handle it.
