Four police officers are approaching a house where the neighbors have called claiming a domestic disturbance. The police knock on the door but there is no answer. They hear a commotion inside, but it's unclear what's going on. The police decide to enter the residence and use a battering ram to force the front door. They enter with guns drawn. A man, in the livingroom, turns to run towards the back room. One officer shouts "gun" and several officers fire. The man is struck by 11 bullets and dies. No gun is found at the scene. The man had just received a promotion at work and was having sex with his wife in the livingroom as celebration.
My predictions: Several people here will say that the police were justified in shooting the man but that the original guy (who shot his wife's 'rapist') should go to jail. Several people here will say that the wife should go to jail for manslaughter but that the mistaken police officer should go free. |

I think the husband must be thinking "I should have killed both of them"
But seriously, that is a difficult question. Because the man acted from both emotion and a sense of righteousness to defend his wife from rape. So in that sense he is innocent. On the other hand, killing someone outright because your wife screams "rape" isn't justified in my book, so I don't believe he is innocent either.

I don't base most of my decisions on deep emotions in the moment. Not to mention, there are better ways to deal with the situation in my opinion... a 2x4 is a good example. You avoid murder charges while protecting your woman. Not to mention how I caught the guy: if he was running away, that would be a bit different from catching my wife/girlfriend riding on top cowboy style and then yelling "RAPE!" Either way, I doubt I would use a gun. I don't make the decision to kill lightly.
