The easiest way to check is with a drug screen, which employees use now. I'd rather refuse to hire someone who fails a drug screen than to find out a week later that he's a doper when he stoned and drops a pallet of lumber on one of my sober employees.

We already have laws like that:
If you are seen weaving in and out of traffic and you are sober, you get a ticket. If you are seen weaving in and out of traffic and you are drunk, you get taken to jail.
