Crime= jail = lack of liberty for period of time = punishment.

Its dumb to allow some one who has been a bad part of society to have the same rights as those who have been good. Those who have been bad need to be punished, and being excluded from the society they have hurt is part of that. Thats why they are put in cells in a building enclosed by walls and guards.
