Would you rather have California (the largest state) make the ultimate decision on what the laws should be. In that case, we would all be able to smoke marijuana. If the people in a certain state want not to have the death penalty, then they are advertising it to potential criminals. Different states have different bar exams because they have different laws and different standards. (Think about how many laws California has compared to Wyoming.)
The point is that people need to make their laws for themselves, and exercise good judgment.
