That's why it should be taken into account in sentencing. Hell, I'd be fine with him getting a very minimal manslaughter charge (just parole).
But still we should not encourage vigilanteism.

There's one factor that could change my mind... Did the man appear to be still threatening his wife at the time? Then it is self defense.
But shooting someone who is running away... That's vigilanteism, not self defense.
Deserved or not (for the very reason this case illustrates. The man who was killed was wrongly killed).
