It does not matter if he was in grave harm. He believed his wife was. He as a husband has the moral obligation the God given and legal right to protect his family.
A civilian is authorized to use deadly force in the home, in the following situations. (depending on state, and GA is one of these states).
To prevent death or serious bodily harm to himself, a member of his family, or a guest in his home.
Rape is considered serious bodily harm.
GA has a very wide open castle law, as well as the stand your ground law. Simply breaking in is considered a violent act, and therefore deadly force is authorized.
She got what she deserved, and the husband was well in his rights. Legally, in that state, he still had the legal right to shoot him dead, even if he was running away. Just as long as the man was still in his home. Because you can not tell if he was running for a weapon, or not.
The Castle doctrine also removed the “duty to retreat” law in GA. Meaning. That a victim has the right to use necessary force in any establishment or place that they have a legal right to be in, if they are attacked.
