I'm fine with throwing the Constitution out and replacing it with a new one, but for the time being, we have what we have.

How does military action go against the Constitution? It specifically says that the President is the Commander in Chief of the military. Meaning that he can tell them to do, whatever he wants. It is kind of like a squad leader telling his boys that they need to charge that machine gun nest. He can do that because he is their leader.
