There are a lot of things that are legal that are illegal in my opinion. But that does not make it illegal.
Even if (for the sake of argument) you are right (which you aren't) and that it is Constitutional (which it isn't), I would still disagree with it on a moral and principled reason. Which trumphs the Constitution any day.
