It is the womans choice to have an abortion. If someone causes the death of her child, which she wanted, that is a fetal homocide. It all depends on whether the woman wanted the baby or not.

If I kill my 3yr old son does that mean it's okay. After all I could say it was my choice, and I did not want him. What difference does it make if the child is inside or outside of the womb, as a parent they are your responsibilty until adulthood.

A pregnant woman is not a parent until that baby has been born.
Killing a born child is different to killing a fetus. The fetus is not yet independant and still relies on another person for survival.

As said by Billy Bob in another thread a 1 month old baby is not independant and needs to look to another person for survival.

Governments don't have rights, they have 'authority'. And yes, the US government has the authority to interfere in this matter.

This leaves it up to the mother, and so in an ideal world it would be up the mother whether to determine if the fetus was a human or not and therefore whether or not a double murder was commited. Unfortunately the mother is dead, so we assume the mother would consider the fetus a child and don't really care if we aren't giving the murderer the benefit of the doubt.
What if a woman decides that the child is a fetus until it is 5 years old?

to your second point the "authority" is granted by the electorate, the "ethos" of that "goverment" should reflect the manifesto it was elected on.
to your third point, She would be an "Elephant" with delayed gestation

Because it is her body until the fetus can survive on its own.

because its her body her choice? plus i think this is only the case when the pregnancy is very far along. most abortions happen early in the pregnancy.

You are incorrect, per google the phrase mostly unique comes up with over 3 million hits making the use of the phrase not so unique. http://www.google.com/search?hl=en&q...=Google+Search

It will always be her body even after the child is born. For someone called commonsense I think your argument doesn't make any sense. Maybe I have misinterpreted your meaning if you could please hlep me understand what you are saying.
