KENTON, Ohio - A judge decided two teenagers can complete their high school football seasons before they serve 60-day jail sentences for a car crash caused by a decoy deer placed in a country road. Two teens were injured.

Gary McKinley, a retired Union County juvenile judge hearing the case in Hardin County Common Pleas Court, said he knows his decision will be criticized.

"I shouldn't be doing this, but I'm going to. I see positive things about participating in football," he told Dailyn Campbell, a junior quarterback at Kenton High School.

A court administrator said McKinley had no further comment Wednesday because of pending charges against other defendants in the case.

Campbell, 16, and Jesse Howard, 17, were sentenced Tuesday to juvenile detention, to start after the season ends.

Last November, teens stole the decoy from a man's home and created a base to help it stand upright because it had only two legs, Prosecutor Brad Bailey told the judge. They drove up and down the road watching as drivers swerved to avoid the decoy. Bailey said Howard didn't stop the prank.

When Robert Roby Jr. of Kenton swerved to miss the decoy, he crashed his car into a pole and fence. His neck, collar bone, arm and leg were broken. His mother said he's facing his 11th surgery.

She said he's not able to work or go to school and referred comments about the case to her lawyer.

His passenger, Dustin Zachariah, has brain damage, Bailey said.........
Is the sentence not light enough without delaying it for football season? It's tough when 2 kids have to pay for the mistakes they make. The victims will pay for it the rest of their lives. One year from now, the perps will be home free. From some of the other linked stories, it appears that the deer was placed just over the crest of a hill. They knew when they put it there that there was no time for a driver to react. Some "prank".

Doesn't shock me. Excuses seem to get made for jocks by their adult counterparts. I'm surprised they didn't just throw away the charges. "Wellll, they're just boys and boys will be boys and... I got money on this game!"

I can understand making the sentence light since it was obviously an immature stunt not intended to do damage and the results were likely a shock to the kids. I can even understand taking into consideration how jail might screw up the kids more than fix them. It wouldn't bother me if they were put on a hell of a lot of community service instead of jail... something like that... even postponing because of SCHOOL... I could deal with that a little.
But I don't see how there is any reason why they should postpone a sentence and get special treatment over football.
Hell, the parents should be making them quit the football team if necessary to teach them a lesson. If it weren't for lawsuits these days and all that garbage, the coach should kick them off for disgraceful behavior.

Yeah.....it's an absolutely crazy judge's ruling. Can you imagine Enron's Andrew Fastow saying to a judge....."Judge, can I please wait until I've got my kids raised before serving my sentence?"....and then the judge granting it??????

Why do I have the strange feeling that if this was poor little Georgie who did this reckless stunt, and that terrible Little Billy was the driver who crashed, JP5 would think it absurd to punish Georgie over a simple schoolboy prank, (&) besides Little Billy had to be speeding or at least it was his failure to control the vehicle, that was the most contributing factor of the (so-called) accident??? Sorry, 12th. Can't defend that even as a devil's advocate. His reasoning -- that football has many positive effects on players -- may be true, but it's a specious reason to delay a sentence. And being forced to miss football season might have many positive effects, too.

On the plus side, they're not escaping the punishment. And I'm betting they don't get much enjoyment out of the next couple of months, with a jail term waiting just ahead.

And it probably has them *really* motivated to make the playoffs....

you'd think a Texan would be celebrating a pro-football ruling. My God, you have High Schools that have better facilities than many colleges and dads who keep their boys in 5th grade for two years so they'll be older in highschool for football.
