Can't we all agree that hate crimes are bull(*)(*)(*)(*)? Aren't all crimes like this hate crimes? (*)(*)(*)(*) i've had to get in fights (in my younger days) just for the way I dressed. I feel sorry for this man, but 5 years is ludicrous, most assaults only lead to months, if any jail time.

Man on man rape is rather routine in prison, and I don't think its funny at all.

They shouldn't be any harder to prove than any other hate crime scenario. The fact that different standards are used is quite telling. It shows that we automatically assume that crimes committed by majorities against minorities must be hate crimes and that crimes committed by minorities against majorities must not be. So much for justice being blind.

I agree with you and Unifier on that; nevertheless the law is the law until it is changed or repealed, and the law says this is a hate crime by its very definition. Yeah, a person is just as dead if someone shoots him for being gay as if he wanted to rob him and the punishment should be the same, but here we are.

I'm still trying to wrap my head around the idea that blacks aren't capable of committing hate crimes because they used to be oppressed. Someone explain that to me.

I never liked the hate crime law and agree all crimes like this are indeed hate and should be treated equally with the same fierce message, it will not be tolerated. The problem is that there seems to be too much variations on rulings prior to this. We wanted to make sure that those who target people simply by color or sexual orientation get the max. This leaves open a path to be more lenient in other cases when applicable. I don't like it. I wish we just treated all violent crimes like this as hate crimes.

agreed but if most prisoners weren't so ugly and oppressed it wouldn't be that bad. like if prison was filled with brad pitts then that would be okay.
