I don't get your "woodshed" comment. It sounds to me more like he's simply trying to make the case that McCain doesn't really understand the ruling. Will says..." Courts retain considerable discretion regarding such requests." That's good news, IMHO---IF Will is correct on the reading of the ruling. However, considering at the end of the article George Will makes an unrelated admission of an error in something he'd stated about Cuba.....I'd say even George Will doesn't always get HIS own facts straight!!

Perhaps so. But I agree with Scalia who said that "the nation will come to regret this court's ruling today." Add that to the fact that Obama wants to go back to treating terrorism like a common criminal offense as Bill Clinton did----and it's a recipe for disaster if he's elected.

Exactly!! So, where do you think these detainees will choose to take their cases? Most likely the 9th Circuit Court in San Francisco.

I agree with Judge Roberts. So, these detainees who have never stepped foot on our soil and are not Americans or anything close, are being given OUR rights. They were given "the most generous set of procedural protections EVER afforded aliens detained by this country as enemy combatants"------BUT apparently for the libs on the court (and George Will) this isn't enough.

Does anyone know how we handled enemy combatants prior to 9/11? What procedural protections did we give them previously, if any? Did we actually detain aliens classed as enemy combatants before Gitmo?

I'm curious as I have no idea. I mean, I would think we have, but it's not something I've ever heard addressed specifically.
