I generally agree. But when the prosecutor only asks for $25,000 bail, and the crime only carries a 1-year prison term max, what's a judge supposed to do?

I would heartily support a law requiring very careful weighing of very specific data in sex offender cases. If it takes a few extra days to set bail, so be it.

One thing worth noting: The judge expresses surprise that the prosecutor is asking for $25,000 bail given that Duncan appeared in court on a summons. The reason the judge is surprised is that someone who voluntarily answers a summons to court is generally not considered a flight risk. The bail the prosecution was seeking would more usually be sought if an arrest warrant had been issued.

Change the bail guidelines as well. I'd also change the laws in Minnesota, one year for child molestation? That is a joke. Not to mention that he had a prior conviction, the sentence should automatically double if you had a prior conviction for molesting a child.

I think you'll see a review of the guidelines. I agree that with sex offenders second offenses, no matter how minor, invite having the book thrown at you. As for the base guidelines, it depends what "sexual touching without violence" covers, and what the guidelines for comparable crimes are. It could be a very broad charge that needs to be broken down into degrees of severity.

This dude is sick. IMO this is worse then seal getting his head chopped off (had it been true). These deranged individuals that are freely running around are the biggest threat to security of the people.

I think there needs to be harsher punishments for sex offenders but not all sex offenders deserve such harsh punishments like in some cases where consent can be misinterpretated. The parole board idea is a (*)(*)(*)(*) good one though.
