Default Courts Rules Against Gov't

YEAH! And I don't even like cigarettes or tobacco. But it IS A LEGAL PRODUCT. This stupid lawsuit was started by the Clinton administration. Today's stock market sure LIKES this news!! Now....it will probably go to the USSC....and I'm sure they'll affirm this Federal Appeals Court ruling. Would be shocked if they didn't.

This is good news... but there is a better and much more important ruling that has been handed down recently...

Unsurprisingly the MSM hasn't really reported on it to my knowledge...

"A U.S. appeals court has ruled the IRS cannot compel taxpayers to turn over personal and private property without a federal court order and that taxpayers can ignore the agencies summonses until actual enforcement action is taken."

Default Need more details

I'm not so sure how I feel about that one. The IRS needs some ability to get people to comply with paying their taxes. When certain people don't pay their taxes......and their fair share.....that's more taxes for YOU and ME.

I'd need more details to decide if I like that ruling or not.

They DO have the authority... IF they get a federal court order...

EXACTLY the way it should be...

Obviously you have never had face-to-face dealings with the jack-boots at the IRS.

Before this ruling, the IRS made it policy to "ambush" taxpayers and confiscate ALL their belongings before a hearing ever took place. The taxpayer had the burden of proving his innocence.. not the IRS having to prove their guilt.

On the first one... The government has the ability to outlaw tobacco. They have helmet laws to protect people from themselves, why not outlaw tobacco?$$$ Seems to me someone should sue the government for failing to protect them. It makes just as much sense.

On the second one... The IRS has always operated under the "guilty until proven innocent." Who hasn't heard of the nightmares some people have had to deal with when the IRS abuses it's power? Now the constitution will apply to the IRS, too. It's about time!

Instead of suing the tobacco companies for 280 billion for misleading the public, shouldn’t we just outlaw nicotine? If people want to smoke they should be able to smoke. I personally hate smoking by the way.

The article says: “The government has described the $280 billion as an estimate of money the companies earned illegally through fraudulent activities such as marketing to children and denying doing so.”

What about companies earning money through illegally addicting someone chemically? Would that hold up in court? Has this already been brought up? I’m just curious.

How exactly does someone force you to use their product? As usual the gov't is lost.

That would seem to me to hold some weight. I will defer to the more litigious among us to clarify but you do raise an interesting point!
