Date set for Croatian genocide suit vs. Serbia

THE HAGUE -- The preliminary hearing in Croatia’s lawsuit against Serbia for alleged genocide will take place at the International Court of Justice in late May.

Croatia alleges that the Belgrade authorities are responsible for genocide committed during the war in Croatia.

As the Court announced earlier, the hearing will be held between May 26 and 30, and will be devoted to Serbia’s objections concerning the Court’s jurisdiction and the legitimacy of Croatia’s suit.

In the suit against the then Yugoslavia filed in 1999, Croatia alleged that Belgrade had been responsible for the “ethnic cleansing” of Croatian citizens as a “form of genocide,” as it had directly controlled the activities of its armed forces, secret agents and various paramilitary formations on Croatian territory, in the region of Knin, eastern and western Slavonia, and Dalmatia.”

According to the suit, “a large number of Croatian citizens were displaced, killed, tortured or unlawfully imprisoned, and their property destroyed.”

Zagreb wants the International Court of Justice to find Serbia guilty of contravening the Convention on Genocide, and order it to pay Croatia damages to be determined by the Court.

Besides the Court’s permanent members, the trial chamber that will hear the case in May will include Judge Milenko Kreća representing Serbia, and Budislav Vukas representing Croatia.
