There are other privlages that every other honest citizen has that they are not allowed as well. But oh well right?

I was not pointing out that it was not fair. I could care less about fair. As it is written, everyone has the right to pursue happiness. By treating one group differently you violate this right.

but nobody is treating them differently. no man can marry another man. it doesnt matter if hes gay or straight.

That arguement's as old as segregation. The right to marry someone of the opposite gender is inherently discriminatory. What if it was a law that banned gay sex? Would you say gays aren't being treated different then? Or how about a 50% tax on everyone making over a million dollars? It applies to poor people too, so that doesn't discriminate against rich people? Your logic doesn't work.

no its not. and again, its not a right, its a privilege.
in order for that to be discriminatory, it would have to state, that only gays are banned from sex. banning anal or oral sex would affect many more straights than gays..

if it stated gays cant have sex, then yes its discriminatory.
