Default Heller

The SCOTUS is supposed to announce their ruling today at 10:00 am. While we wait on baited breath does anyone have any predictions they would care to share?

My prediction? They will skirt the issue and will leave the 2A alone, instead they will rule that the DC handgun ban violates federal commerce laws and will strike it down. Yes that would kind of still make it a victory for the pro gun guys. But it does nothing to solidify in present day law what the 2A actually means.

DC's handgun ban is unconstitutional.

Americans have the constitutional right to defend themselves.

A win for the good guys.

I just heard the news on the radio. But they did not give details. Did they rule that the 2A is a individual right?

I only caught the tail-end of the story on CNN. But the SC specifically said the people have the right to defend themselves. I'm tring to track down a in-detail of the ruling, but it's looking that way, brother.

Hmm, looks like they might still be dodging that one.

This is what I saw when I read that link.

"The U.S. Supreme Court ruled Thursday that Washington D.C.'s sweeping ban on handguns is unconstitutional. The justices voted 5-4 against the ban with Justice Antonin Scalia writing the opinion for the majority.

At issue in District of Columbia v. Heller was whether the city's ban violated the Second Amendment right to "keep and bear arms" by preventing individuals -- as opposed to state militias -- from having guns in their homes."

Didn't they admit that it is an individual right by default?

Edit to add.

Lonestar times released the Justice's majority opinion. http://w2.hidemyass.com/index.php?q=...RjLWd1bi1iYW4v

Quote:
The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home.

Although we do not undertake an exhaustive historical analysis today of the full scope of the Second Amendment, nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or
laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.

Assuming that Heller is not disqualified from the exercise of Second Amendment rights, the District must permit him to register his handgun and must issue him a license to carry it in the home.

Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our Nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is not debatable is that it is not the role of this Court to pronounce the Second Amendment extinct.

We affirm the judgment of the Court of Appeals.

It is so ordered.

I missed that line. Seems they did. 'Bout time.
