In order to know whether what they were doing was a felony, we would need to know the criteria for determining it. For example, the drug seller was calling and actively attempting to sell. The fact that he had no drugs on him may not matter in Mass, but maybe it does in Florida. If you are caught with a bundle of drugs, you can be convicted of intent to sell. But intent to purchase laws may be drastically different.
although Florida is among the most stringent drug and search/seizure laws in the country due to the I95 corridor for trafficking.

Observation: Lewis was actively attempting to sell drugs. Intent to sell and intent to purchase are treated differently. For example being in possession of alot of drugs shows intent to sell. Whereas there seems to be no reference to an intent to purchase felony in that link.

Question: are all laws involving intent to sell and intent to purchase identical now to those laws at the tiem of the Jesse Tefaro case?

Not exactly, no more active than those in the above story. There was no possession of drugs in that story, only an intent. I also believe Tefaro intended to sell, his wife mentioned a profit on the deal.

Conspiracy laws in Fla were put on the books in the early 60's, I see nothing to indicate they've changed.

It is a big assumption that intent to sell and intent to purchase are treated with the same severity especially given the fact that in the Tefero case it is impossible to know the exact nature of the purchase. Me purchasing a bud of pot from a friend for 3 bucks is not a felony. Without specifics there is only assumption.

Case in point:
"An ''18-year-old busted with joints at the prom'' could only be charged as a minor misdemeanor with a maximum penalty of $100 and costs.

Not assuming that, but in this case that is what happened. And Tefero obviously was talking about a lot more than that if, as his wife said, this was going to be one last drug deal to set them up for life.
