Personally, I think the death penalty is humane.

I'm 38 years old. If I became stupid and killed enough people, I would rather have the death penalty than sitting in some cell rotting away.

Thunk about this. If you knew that you would NEVER be able to leave a prison again, is there any point to living?

When I was in in Illinois back in the late 80's, there was kid named Richard Church from Woodstock, IL. He and his g/f broke up. So he got mad and tried to kill her, tried to kill her little brother, and did kill her parents.

He went on the run for about 5 years before the cops caught up to him in Salt Lake City, UT. I believe he was 22/23 when they caught him. He was 17/18 when he did the crimes.

He made a plea bargain with the prosecution – life in prison w/o parole instead of the death penalty. This was 20 years or so ago. I'm 38 y/o, and this guy is only a couple of years ahead of me. He has spent almost 20 years in prison, and still has another 35 years to go.

Is keeping this guy alive for another 35 years behind bars really humane? And yes, I understand the severity of what he did.

You have basically shown that life in prison is a deterant to murder. If everyone knew that if you kill someone, you spend the rest of your life in prison, perhaps they'd be less likely to go out and kill.

I don't see any moral problem with killing a murderer or a rapist, but the problem with the death penalty is that it is irreversable. If the justice system screws up, than you've killed an innocent man. If you imprison someone, you can at least let him out and make up his lost wages.

Killing a rapist is quite irrational, given it will create perverse incentives for rapits where they are encouraged to kill their victims to attempt escape of their sentence

They will have nothing to lose. If they'll get the death penalty for rape, and the death penalty for murder, there is nothing stopping them from killing the victim because the end result will be the same.

Makedde, I would have to disagree for one simple reason. I doubt the person committing the rape worries about being punished to begin with. If they were, they wouldn't be committing rape to begin with.

You'd have to assume that all rapists are cretinous. That would be a foolish assumption. Marginal deterrence requires distinctions in punishment levels, such that perverse incentives are not created. A blanket death policy would ensure that, once a rapist has committed his crime, he has the incentive to eliminate his victim.

How am I assuming that all rapists are cretinous?

If rape was punishable by death, there is nothing to substantiate the claim that the person committing the rape would have the incentive to kill their victim. Rape is about power, not death.

Its described in your subsequent comment...

By eliminating their victim they would be minimising the risk of a successful conviction and receiving the death penalty. Without a distinction between rape and murder punishments, the rational decision is to kill the victim. We have to assume all rapists are cretinous (or highly moral) to suggest otherwise.
