I don't see any moral problem with killing a murderer or a rapist, but the problem with the death penalty is that it is irreversable. If the justice system screws up, than you've killed an innocent man. If you imprison someone, you can at least let him out and make up his lost wages.

Killing a rapist is quite irrational, given it will create perverse incentives for rapits where they are encouraged to kill their victims to attempt escape of their sentence

They will have nothing to lose. If they'll get the death penalty for rape, and the death penalty for murder, there is nothing stopping them from killing the victim because the end result will be the same.

Makedde, I would have to disagree for one simple reason. I doubt the person committing the rape worries about being punished to begin with. If they were, they wouldn't be committing rape to begin with.

You'd have to assume that all rapists are cretinous. That would be a foolish assumption. Marginal deterrence requires distinctions in punishment levels, such that perverse incentives are not created. A blanket death policy would ensure that, once a rapist has committed his crime, he has the incentive to eliminate his victim.
