Each colony was granted its independence from England separately, not as a group. These newly independent colonies banded together under the Articles of Confederation to form a confederation of united States.

There never was any directive to write a 'constitution', but rather the men that gathered in Philadelphia were there to amend the Articles of Confederation. They actually went beyond their charge in writing the Constitution.

As for States' rights vs Federal, it makes no sense at all to think that the Creation (the Federal Gov't) should be supreme over the Creator (the States). That would be like saying we are supreme over God.

 

The States signed onto the Constitution so therefore are bound by it. In the Constitution the Supreme Court is given all judicial power in the land. This means that any case that comes into their court they will have the final say on unless the Congress changes the law or amends the Constitution. The Supreme Court has ruled that Federal Government Laws trump State Laws when there is a conflict.

Unless States plan to settle things outside of the legal system then they are bound to follow Supreme Court rulings. Paul doesn't believe this so therefore does not believe in the Constitution, only his version of it.
