Well I have been an employer for over 35 years in Texas and Workers Comp insurance has never been optional. Stupid and unknowledgeable comment. The patients in this State have the same right to sue a doctor as those in any other State. How about the Mexicans who steal a real American's identity to get a job? Employers who knowingly hire illegals should go to jail. But illegals who take those jibs should be deported and banished from any future amnesty.
Companies that choose not to carry workers compensation will self insure their company if an employee gets injuries on the job. And whether they have workman's compensation or not, all employers, except public utility companies must report work related injuries to Texas Workman Compensation division. In the end, if an employee is injured on the job and it is the fault of the employer, the employer still pays.

A majority of them were tax preparers who stole the names and SSN's to file taxes and these same preparers are the typical fly by night operations that no reputable tax preparer would be assoicated with. However, not all who are claiming ID theft are truly ID theft victims. Never said the employer is a crook and one does not need a SSN if one is being 1099'd. For 1099, all one needs a taxpayer identification number which can be a SSN, EIN, ITIN, or ATIN. And since a majority of illegals are "day laborers," it is quite possible that most, if not all their work, would be under the limit for a payer to be required to issue a 1099. For W2, yes, but then again, not many illegals steal/buy a SSN for W2 work.

So we are not talking about all [whatever figue you want to use\] illegal aliens here. Second, those that do work will depend on what type of work they do. As I have stated, generally illegal aliens are day laborers, ie 1099. If they are 1099, a SSN is not the only taxpayer identification number that can be used [see general instructions to form 1099 or 1099-MISC instruction for more information]. If the illegal works as a employee, we know that only a SSN is required. the question is whether the employer will follow all the prescribed rules for issuing a w2 as well as having the potential employee fill out the Form W4 and I-9. If that does not happen and the illegal alien is paid under the table, then the employer is not wanting a SSN. For most employers, including household employers, they will receive a fine of $50 per infraction plus a potential civil penalty for not withholding SS and medicare. Thus, this isn't a criminal violation, but a civil violation in the payment of a fine or penalty by the IRS. The point in all this is that for most illegal aliens, they do not want a SSN. They don't need one necessarily for getting an apartment or buying a house. Nor is this based on idealogy, left or right, or whatever else you want to write that is totally baseless in fact and in reality.

The open borders crowd admits to 11 million so it is probably 2 or 3 times higher. If you are correct then not many illegal aliens will have to worry about a lifetime exclusion from any future amnesty if they are caught working with forged or stolen documents so you should have no reason to oppose the idea. But I think the number is much higher and you are afraid too many would get banned from the amnesty.
