http://www.cbsnews.com/8301-504083_...f-he-was-afraid-says-atty-for-victims-family/ Young woman was shot dead while searching for help. Haven't seen this on this forum was wondering how people would react to this same situation.
well he way over reacted you dont shoot someone for just trying to break into a home anyway, he should of called the police, there was no entry into the home to warrant such lethal force
He also said he thought she was trying to break in to the home. I have not seen anywhere where she was armed or had tools to commit a crime on her.
Should get at least manslaughter. What a (*)(*)(*)(*)(*)(*)bag of a human being. He's a threat to others and I certainly wouldn't want to live next to some gun happy asshat who shoots people just because they knock on his door.
I'm thinking murder but this is going by what is reported. Maybe their is more information out there.
Yes. It is. Unfortunately, it's hard to pin murder on anyone these days. So the prosecution will have to try and go for a lesser charge, and even then he'll probably get off.
As much a defender of self defense as I am you don't answer your door with a shotgun blast to the face. Unneighborly to say the least. Makes me wonder about these Detroit neighborhoods tho. Roamed around for an hour knocking on doors and the only answer was a shotgun? Poor girl, poor excuse for a society.
Another victim of gun happy owners and "stand your ground" law! This time, at least, I hope the guy gets the maximum! It's a bad time that those gun happy, stand your ground type get a REAL warning that they can't just grab their gun and shoot anyone they choose.. .especially since it always seems to be young Black people who get it!
What happens if the shooter was black? Race card still applicable? Might want to check Michigans castle doctrine before spouting off about its privledges. This guys in trouble no matter what card you throw at him. Unless of course the prosecutors buy the story of an accidental discharge to the face. In that case Ill throw the card and hope hes black. Call me rascist if you like, youd know.
What I find really sad is a tragic event occurs that everyone can agree is tragic and someone comes on here with a holier than thou attitude dripping venom for purely political gain. No remorse for the victim lets just stab a knife in what they perceive to be their political opposition. Sometimes politics sucks hard.
To me it does not matter what color the the man is if he shot an unarmed person for knocking on his door he should go jail.
Depends on what the laws of Michigan are in such a situation. Here in Colorado, as an example, if somebody tries to break into your home, you can invoke our "Make My Day!" Law and shoot to kill, with impunity! It is a sickening tragedy that this woman was killed, and I regret what happened to her while noting the measurable decline and decay of the whole country as we sink deeper and deeper, day by day, into this ****ed-up mess called the 21st-Century. It would be easy to pick on Detroit, and say that this was more likely to happen there because it is such a rotten, hyperliberal puke-hole. But that wouldn't really be true. This sad thing could have happened in parts of Denver just as easily....
For a conviction it obviously shouldn't matter. Its the aftermath, the sum of the equation is the answer.
From what Ive read Michigan allows deadly force against force. That doesn't seem to be anywhere near the case here. An unjustified shooting accidental or not. Beyond that I agree fully with your dystopian outlook.
No idea about murder charges, I'm not a liar (pun intended) But even if the prosecution believed the accidental discharge I would think its negligent homicide. I see a difference between a family member having an honest accident and killing a loved one. Stupid as hell but an accident that's truly regretted. This guy started off brandishing a weapon with intent. His intent may have started with honest defense but it didn't end that way. Personally I see a big difference between the two scenarios. No idea what the law thinks.
I agree, if your that "scared" you do not "open" the door in the first place if they do break in and enter the house, then that is a different story...
IMO and based on what has been reported thus far the shooter will be convicted of some sort of homicide charge.
nor do I, I think everyone, even felons and people with mental conditions that are self reliant should be allowed to protect their homes and families, what I would control though is where people can take those guns, such as a airport, schools, prisons, hospitals, mental institutions, ect... I do though think that operating a gun under the influence should be illegal .
