I disagree with the ruling. Open carry should be allowed everywhere and concealed carry completely in the discretion of the state, including a total prohibition if they so desire on concealed carry.

Why? If open carry is common, that's one thing. But if it's not, and I'm open carrying and nobody else is, that's just a "shoot me first" sign. While I would like to see open carry become virtually universal, we're nowhere near there.

Common doesn't matter to me. The Constitution clearly envisions state action when it comes to militias, and the right to have guns is clearly tied to the militia, ergo the states have Constitutional authority to regulate. The Second Amendment is as subject to time, place, and manner restrictions similar to freedom of speech. If having to have a permit to conceal is legal, than it is already regulated. If California wants to ban the practice they should legally be able to just as long as open carry is allowed. There is no right to privacy regarding one's firearms in a public place. If it makes you a sitting duck, so be it, but more often than not, I would imagine the message isn't "shoot me first" so much as "just keep on walking".

It is DC v. Heller, so maybe you should go read it again, paying particular attention to the fact that the case had to do with what guns you have in your home and what way they have to be stored in your home, not on concealed weapons permits.

Libs aren't aware that any infringement on the 2nd A is unlawful. In all truthfulness, even a CCW is a form of registration. Some of us that back the 2nd consider that the knock on the door.

You are the one who raised Heller, and Heller clearly states that the Second Amendment is not sacrosanct and is subject to regulation. Since what is or is not "lawful" is ultimately decided by the Courts and is a moving target on any given day, what anybody who doesn't sit on one of the benches considers lawful or unlawful really doesn't mean much whether it is you, me, or the guy down the street.

You have that exactly backwards. The existence of the militia is tied to the people's right to keep and bear arms.

Yes, thanks to Scalia's judicial activism, the whole country will have to be the wild wild west.

Right, because Washington, Oregon, Nevada, Arizona, Florida, Utah, and all of the other 36 states that are shall issue for concealed carry are the wild wild west.

News flash; they aren't. Blood isn't running in the streets of those states, people aren't shooting each other over parking spots and petty disputes. The irrational fear that people have of law abiding citizens legally carrying firearms is something I will never understand.

And these incidents have what to do with legally carrying a firearm, exactly?

I have no fear of law abiding citizens carrying guns at all. Straw man.

It's the non law abiding citizens carrying guns I worry about.

They were all carrying a firearm.

Those weren't legal firearms? Legal firearms become illegal ones.

These crimes were not committed by people who were legally carrying firearms. Hence they were illegal.

Legislation only pertains to those who choose to abide by laws. The court's new ruling in no way will effect criminal activity.

That's the problem. Folks using legal guns illegally.

If everyone used them legally there wouldn't be an issue.
