Trump’s 1st SCOTUS Appointee Threw Down Constitutional Gauntlet During Moving Speech

    If there were any remaining conservatives who had a doubt that President Donald Trump picked the right man to succeed Antonin Scalia on the Supreme Court, Neil Gorsuch should have made them believers Thursday night.

    That’s when the newest justice on the nation’s highest bench delivered a speech to the Federalist Society in which he threw down the gauntlet on constitutional originalism, the judicial philosophy of both himself and the late Justice Scalia.

    “Tonight, I can report that a person can be both a publicly committed originalist and textualist and be confirmed to the Supreme Court of the United States,” Gorsuch said, according to the Washington Examiner.

    “Originalism has regained its place at the table … textualism has triumphed … and neither one is going anywhere on my watch.”

    The Federalist Society is a right-leaning legal organization that Democrats have accused of being a secretive enclave from which suggestions for President Trump’s nominations to the federal bench have emerged. During his Thursday remarks at the Antonin Scalia Memorial Dinner at Washington’s Union Station, Gorsuch chided those pushing that narrative.

    “For starters, if you’re going to have a meeting of a secret organization, maybe don’t have it in the middle of Union Station,” Gorsuch said, according to The National Law Journal. Union Station, a D.C. landmark, is the chief rail station in the nation’s capital and serves as a hub for the Metro as well as a prime retail destination.

    He also said that if it wants to remain secretive, the society should also abandon its very public stances on our judicial system, such as that a judge should “say what the law is, not what it should be.”

    “You’re a bunch of radicals,” Gorsuch quipped.

    But humor aside, Gorsuch’s speech was a testament of fealty to the Constitution that was moving to any conservative who cares about the future of the country.

    Not familiar with originalism? Well, I can only assume you’re a liberal reading through this just to post an angry response and not one of our regular, well-informed Conservative Tribune readers.

    However, Scalia himself described the judicial philosophy best: “The Constitution that I interpret and apply is not living but dead, or as I prefer to call it, enduring. His judicial philosophy is correct. It is right to look to the intent of the founders rather than try to bend the document to meet some progressive need of the moment.

    Scalia was far more than an originalist.

    He wanted to change society backwards.

    Not going to happen.

    Gorsuch is playing to his base, but you are going to be very, very disappointed with most of his opinions.

    It’s not me who will be disappointed by his rulings. He’s going to be a great originalist conservative Justice.

    Only in your dreams, my friend. He is big on following precedent. I do not like his standards generally on the idea of corporations as persons, but he leans to giving unions and governments the same person hood in law.

    There is no way that we collectively today could write as good a document as our present constitution is. We are best off keeping it and amending it as needed and as ratified by at least 38 of our 50 states.

    Are you a psychic? Can you look into my mind and know what I believe on the deepest most personal level? Your statement is stupid on the face of it. Please tell me in depth and in detail how you serve the best interests of the Republic. My avatar has to do with the belief that America has failed miserably as a secular nation and is steeped in the sewage of the perverse agenda of the left. If we are to survive as a nation we must recognize that we are weak, fallible beings, adrift and powerless when we embrace the vanity that there is no power higher than our own. Every ill that we have ever suffered individually and collectively was the result of such arrogance. I love America above all but God and without God America is lost.

    I am no more psychic than are you. I evaluate you by what you write. Your words are not God fearing, I believe. Your words don't serve the best interests of the Republic, I believe. You claim you can't be judged, yet you judge others. Your idea of the left is only that because you are so far on the right. I love and honor God and His Son, Jesus, whom I call Lord and He calls me by my first name. Those who follow Christian dominionism do not really know the Lord.

    Not all of the original writers of the constitution were slaveholders. The US Constitution was a remarkable document for its time and that it is the longest lasting written political document is testimony to it and its writers brilliance.

    God has immensely blessed America from our founding and the Devine providence involved to making us a global economic and military power after we got rid of slavery, to helping us win WWII and the Cold War. There will come a time we will reject God completely and cease to receive His blessings but at the end of the world all nations will have that fate.

    That's nice but I am not a Christian, do you condemn that too? I do not fear God and no one should he is the embodiment of love. God is only benevolent all of our troubles we bring upon ourselves. Again what do you do that serves the best interests of the republic?

    I’m curious about which god is referenced in this thread. There are many versions available: Christian(several flavors) , Jewish ( several flavors as well), Muslim (at least two major flavors) and several minority candidates.

    To which one(s) do we attribute our wealth and power to ?

    The Bill of Rights. An agreement to obtain passage of the Constitution back then has been diluted by the equal protection clause of the 14th to where the Federals have empowered themselves at the Liberty Expense of the States and Individual.

    The 14th, with several unrelated sections, check it out, was passed by the
    States under Reconstruction in order to gain their full admittance into the :flagus:
    No passage, no end to their occupation.
    I find it abhorrent the 14th should be used to disembowel the Bill of Rights.


    BTW consider Health, Welfare, Education, Housing, are not powers granted to the Federal gov't and are therefore reserved for the States. The Greatest State of California did a better job at indigent medical care before MediCaid. A better job at education before CORE.




    If I have not explained well enough, please tell me what part you don't get?
    Or is it you profoundly disagree?


    BTW a problem with the Court is they are all Career Federals.
    No State Supreme Court Justice or like Earl Warren - a State Governor.
    There is no State or Private sector representation among the justices.
    So they too easily think "Federal" unless they are strongly principled.
    And the 14th is their stepping stone to Federal increasing empowerment.

    You are shifting the argument. You should not fear the Lord. You should try to treat your fellow human being fairly. If you do that, you will be serve the interests of the Republic. If you are not Christian, so what?

    @Moi621 , I must be reading a different document because the 14th puts teeth into enforcement of the Bill of Rights. Even after the amendment was added, many states passed laws the disenfranchised its citizens. You mentioned a few examples yourself including education(separate but equal).

    I am glad to hear you believe in the Bill of Rights , which makes you statement about placing god above country puzzling. Were it not for a country like the US , which god you worshipped would be an accident of birth as opposed to a freedom of choice.
