The provision for gun control laws is written in most State Constitutions that have the right to bear arms written in their Bill of Rights. Not all States have the right to bear arms in their State Constitutions. Florida has a three day mandatory waiting period to buy hand guns in its constitution but it says nothing about long guns. So theoretically you can walk into a Florida gun store and walk out with a rifle and ammo in two minutes.

Assuming the FBI had followed up and discovered something what could they have done? He had broken no law and they had no way to take his weapon away from him that I am aware of. There are a few states that have rules that permit law enforcement to take guns from those they consider a danger even if no law was broken, but I doubt Florida is one of them. What federal law would have allowed them to intervene.

Proving someone is mentally ill, which might have allowed this although I am not sure, requires legal action.
