No one who is prescribed a controlled substance should be allowed to possess a firearm unless their doctor is will to tell the govt. they think he/she would be safe. DEA has a nice list of all persons in the USA who are prescribed controlled substances, this list should be added to NICS. Doctors note from their prescribing physician & therapist should be enough to appeal this and get them off the list.
I think this is a bit of over reach myself....but I like that you are thinking about creative ways to reduce gun violence
Your kidding right? I get in a car accident and have a relatively minor injury and doc gives me 2 weeks of Vicodin and I should have my guns confiscated, and have to battle bureaucracy to get them back? Are you for real?
i mean psychotropic meds for personality disorders, like depression, anxiety, bi-polar, schizophrenia, etc. Not pain killers.
Ron, the message you're sending is that if you want to keep your guns, don't see a psychiatrist, and do not accept a prescription for any drug on "the list".
ACLU has already gone to court and blocked a very similar law dealing with mental health professionals. You have your due process backwards though. Govt should be going to court to have rights stripped for a stated purpose. Not a blanket order and people then have to go beg for their rights. And in many ways I agree with your line of thought, just not the method you laid out.
First, there is some confusion, Controlled medications such as Morphine, Codeine, Narcotics, have Medical uses and are prescribed using a triplicate document and audited by D.E.A. Medical Marijuana is NOT in that category. To continue, Haldol, Haloperidol Antipsychotic medications are not Narcotics or controlled as such, Antianxiety medication Xanax is addictive and subject to control, Buspar is not. Finally, only illegal sustances or illegal habitual use of substances is the only bar to firearms ownership not to include patients under treatment for PTSD or Depression. Finally, there is something called Doctor / Patient confidentiality, and agreement giving Patients seeking Mental Health treatment protection, that whatever they divulge to a treating Physician is confidential and Priveledged information, same as the Attourney Client relationship. If a Patient is found to be a danger to themselves and others, three Psychiatrists, a Judge upon evidence presented, can order a Patient to be involuntarily commited to a Mental Health treatment facility, until found otherwise.
if someone thinks their guns are more important than their mental health, that's their cross to bear.
Ronstar I admire your bravery. But I think you will find your gun freedom mates are more moved by notions that improve gun freedom as opposed to public safety. The only public safety arguments they will support are ones which improves gun freedoms, i.e. arm teachers.
Since, You have no proof anyone actually feels that way, it is your own biased opinion of people that own guns since it would seem obvious by your own statements against, that perhaps you are barred from ownership of firearms. Best to leave such things to the Experts of Mental Healthcare.
No, in My time in Healthcare, Medical Legal and Medical Ethics occupied much study and test time. That is what guides Me in these matters as well as education to help guide Patients to seek needed help at the appropriate level of care when indicated by signs and symptomology as observed and documented. People not understanding the complexities and protections in place see only a monoissue and not the incentive or motivation a Patient needs to seek help, by means of protection of confidentiality of Priveledged information.
Let me clarify, I meant controlled substanced used for mental health issues. not pain killers. and appeal process should be efficient and easy. letter from your regular psychopharmacolist should allow you to posses guns, if he feels your safe to have guns
If they are suffering from mental illness their thinking may not be perfectly logical. It doesnt take a medical degree to figure that out.
It takes not only a Medical degree, it takes years of clinical work and observation, practice, and C.M.E. and countless hours working with Patients and in particular, a Patient, in order to make a determination, and consults with other Mental Healthcare professionals before making a decision a Patient should not own firearms.
Hence why you are not a Physician or Mental Healthcare practitioner. Edited to add: Hence, why If I need care, I seek a qualified Physician not a grocery store clerk with no Medical degree and experience....etc....
Ron, I remember when there was a certain amount of paranoia about returning veterans. There was a narrative spinning around that a vet with PTS might just get a gun and go on a rampage. Remember that little phase the left wing went through? Well the consequence of that was that returning veterans would not report their PTS. And they thought that, for serving their country when the country called, they would be stigmatized and have their rights taken away. I know what you're after. You're after not having dangerous, crazy people with guns. I agree with your goal. Finding the right answer is the challenge.
