That's illegal, his lawyers would have a field day with it and it would be tossed. You can't lower federal charges to state charges just to avoid the chance he might be pardoned.
If Mueller doesn't have a case without Trumps testimony then he has no case and should end it. If he needs to entrap the President to win then he is a worthless man.
The answer from Trump's lawyer should be "no." One reason given is most those questions contain matters that include national security secrets, lawyer-client privileged, or have executive privilege. The mere leaking of the questions proves that Team Mueller absolutely can NOT be trusted to keep anything secret. Trump should refer to Mueller as "Leaker Mueller" from now on and say Mueller is a national security risk.
Is there any question in your mind that Mueller cannot subpoena Trump? Now Trump could fight that in court, and if I were him that is what I would do.
