    I don't know what info was presented to the grand jury that I am not privy to, but based on that which I am, I think they overcharged. I reserve the right to change my mind as more info becomes available. The danger of overcharging is that if the guilty thinks they're guilty of something, but not as charged, they may let them off entirely, especially if they don't have the option of lesser included offenses.

    There is always that danger, but she shot and killed a guy in his own home. Nobody ambushed her or forced her into a split second decision. She wasn't even on a call of reported gunshots or violence. I think it's the right call in this case.

    I think Roy Oliver from the Balch Springs shooting of Jordan Edwards a couple of years ago was an overcharge, yet it resulted in a murder conviction. I felt that actually was murder 2 or maybe manslaughter. I think this girl will be convicted. She will have a very hard time getting a favorable jury in Dallas and most other nearby districts.

    While that's true on its face, if her interpretation of the events is in fact accurate, she reasonably THOUGHT she was being ambushed in her OWN home. Trust me, if I walk (well, in my case roll as I'm restricted to a wheelchair) into my own home and an intruder starts coming at me, I'm going to shoot first and ask questions later. Of course I have an advantage over her in that my home is not next to, under, and over cosmetically identical units. It would be hard for me to claim with ANY sort of credibility that I walked into a neighbor's house thinking it was mine, especially given that mine is the only one I'm aware of anywhere close with a wheelchair ramp leading to the front door. (And without that ramp, I couldn't get in anyway.)

    But my circumstances are not the same as hers. I'm reminded of my late grandmother's apartment from when I was a teenager. Accidentally get off the elevator on the wrong floor without realizing it, and you could easily innocently end up in the wrong unit.

    Which leads me to my one BIG question. If she didn't break in, and I've seen no information that says she did, HOW did she get in??

    She might have been charged with murder but her bail was less than it was before. That is a good deal. How many people charged with murder in Texas get out on bail? Chances are she will get off and get her job back with back pay.

    IIRC, the door was ajar. If so, that supports her story. Cops are used to being targeted, especially since the Dallas sniper and the terrorist BLM rhetoric. Pigs in a blanket, fry em like bacon. This may not have happened but for the rhetoric. Any Dallas cop would be on edge.

    Since she wasn't acting under what I believe is called the "colour/color of authority" in the US will she be able to avail herself of the defences usually available to police officers who kill while acting to discharge their duty?

    Cop lovers will make excuses for killer thug cops if the thug cops blasted their own mothers in front of them. Don't worry, Amber will skate and get her job back with back pay and a promotion.

    I doubt if this police officer will be let off entirely. Her story is full of holes.

    I don't think she will be found "Not Guilty". Too much evidence against her.

    Not much of a "cop lover" but this is Dallas, do you have a clue about the Dallas sniper? Cops shoot more unarmed whites. I have no love for the domestic terror group of BLM. If the victim was white, there would not even be a thread on it.

    She wasn't acting in defense of anything. In the US, though, I don't think that "color of authority" matters much for justifiable deadly force. Even a concealed carry holder who isn't a law enforcement officer can use their firearm in deadly force in order to prevent certain felonies and/or in self-defense or the defense of another.

    In other words, had this actually been her apartment, she'd likely be found justified in the use of deadly force against an intruder where she was acting as police officer or not.

    "If" is a big word. If she had been in her own apartment, she wouldn't have seen that Black guy that she shot.

    No court would, or should, use "but I head/saw something scary a few years ago and I've been on edge ever since" as an excuse. "But I'm in Dallas" doesn't chang anything about how BS that kind of an excuse is. And I should point out I don't think she is using that as an excuse.

    She attempted to use her key but it did not work. The resident opened the door to see what was going on. She panicked and shot him to death. Obviously, a second degree murder case but I'm betting she will go off scot free.
