Correction, a man being agitated, refusing to comply, and refusing to drop a potential lethal weapon is treated a little less than like a man with a gun. In the Shaver case, most of the officers had their guns pointed at him. In this case, one officer had his gun out but pointed toward the ground while another was holding a less lethal shotgun like a suitcase.

While it is still technically a firearm, it's been converted to shoot bean bag rounds and policies are written on what you can load in them.
