If they lose in the lower court they can appeal to the appellate court if they lose in the appellate court they can appeal to the SCOTUS. Alabama is not filing the initial lawsuit but the state legislature passed the bill so someone would, someone who has standing to file the lawsuit. Standing only applies to who is doing the suing. Alabama has "standing" to defend the state.

i applaud any legislative move to protect the life of the most innocent among us, that being of unborn babies, of course. but i do make an exception in the case of rape, so, yes to the extent the alabama legislation restricts a rape victim’s access to an abortion, i will say they made the wrong call. however, my preference would be for the baby to be delivered and offered for adoption to a loving family. but i can’t make that decision for someone who has been brutally assaulted in such a vile manner. that is between her and god. that said, i’d like to suggest the best thing to do would be to prevent the rape in the first place. for example if someone tried to rape me, they’d get know what it feels like to have your brain blown out the back of your skull through the very large hole my .357JHP will make. i have told you i will support a rape victim’s right to end her rapist’s pregnancy. will you support my right to keep and bear the tools i need to defend myself from a rapist twice my size? significantly reducing the chances that i’ll ever be faced with making such a difficult and terrible decision...

Women have been charged with various crimes stemming from substance abuse during their pregnancy and also for giving birth to drug addicted babies? At what point do fetuses have rights? We took a few steps back from the cliff this past week. The GOP state senators sold their soul over the business tax deal and got a commitment from the Dems to not push any gun control bills through in the near future. I just hope the few steps back are not just so they can get a running start.
