    The grand jury brought no charges now the New York Office of the DOJ. Once again the case of someone resisting arrest causes their own demise and the left turns it into a racial issue.

    "Despite disagreement between top prosecutors regarding the strength of the case, the U.S. Department of Justice on Tuesday ultimately declined to bring civil rights charges against the New York City police officer involved in the controversial and racially-charged death of Eric Garner -- with Attorney General Bill Barr stepping in to make the ultimate decision, a person familiar with the case confirmed to Fox News.

    Garner, who was black, died in 2014 during his arrest for selling loose, untaxed cigarettes outside a Staten Island convenience store. The 43-year-old refused to be handcuffed, and cops -- including the white officer who the DOJ declined to prosecute -- took him down.

    A senior justice official familiar with the case told Fox News the DOJ's Civil Rights Division recommended charges be brought against officer Daniel Pantaleo -- but the U.S. Attorney's Office in the Eastern District of New York disagreed, saying the government's burden of proof could not be met."

    As the spokes person noted in the press conference the so-called choke hold which was really just a slip of the forearm lasted less than 7 seconds and Garner was able to breath and speak for several minutes after the initial scufful he started. Time for the NYPD to stop their attempt to charge the officers involved.

    I do respect cops, but, I watched this beefy cop holding this guy now by his neck, you could hear him say, I can't breath, and he never stopped. There were four or 4 other cops laying on this person, and this guy kept his pressure on this guy's neck. And, all this guy was doing was trying to sell cigarettes that were not taxed. I cannot believe this cop coward has not been fired. He had him down by the neck when he could not possibly move, with the other cops on him at same time. And, Garner had no gun. I'm glad they protested at the debate and hope they keep it up to DeBlasio.

    The reality is this man was killed because he was selling untaxed cigs. The question is why? Well there is a huge market for them in NYC because of the massive taxes the dems have put on cigs

    There was no murder. Who was convicted of murder? Apparently the Head if the executive in NYC...You know the leftist running for president of your party said there was no murder.

    Typically the procedure is once the actions to place a suspect under control have begun they don't stop until the suspect is under control. This can include ignoring what the suspect or any bystanders are saying. The reason is because once the engagement has escalated to a physical level the only dependable way to de-escalate is with the restrain of the suspect. This approach is the safest way for all involved. There have been instances where officers have allowed suspects to manipulate their way out of being placed in handcuffs only to have the suspect either flee or produce a weapon.

    He died because he resisted arrest and challenged the police to a fight. He died from a heart attack because of that.

    Have people forgotten what really happened here? The store owners had complained multiple times. Garner had been warned and previoulsy arrested as I recall. The store owners, who pay the taxes complained again against the illegal competition and the police observed Garner again selling untaxed contraband. They told him he was under arrest and he challenged to them a phyiscal altercation saying this ends now, no more. It was a legal takedown which because Garner resisted the officers arm breifly slipped around his neck but was then released. Garner was breathing and talking. They he had a heart attack.

    If you can talk you can breathe. He didn't choke to death. His heart stopped because he weighed 350+ pounds.

    Well that and he was being partially strangled and had 4 men sitting on top of him.
    All that tends to add to the stress on the heart. Seeing as how they weren't supposed to be partially strangling him at all, you can understand the concern.

    They guy was executed in the middle of the street by chocking him to death. He was fighting for his life, obviously. And the ill joke is on all of America to call this "resisting arrest". It is rather typical... the high % of black unarmed people who get executed like this by white cops.

    He wasn't being strangled else he could not talk. He died of a heart attacked because he challenged the police to a fight in order for them to arrest him.

    He was not choked to death and yes when you challenge the police to a fight when they are executing a law arrest it is resisting arrest what do you call it?

    I am a right leaning independent and I believe the officer was wrong & this looks a clear manslaughter case.

    I supported the cops vs Michael Brown, but from what I have seen on video, this case needs to go to trial and I would not be surprised with a manslaughter conviction.

    He was beating the State of New York out of their beloved tax revenue. To make matters worse he was pocketing it himself as profit. In liberal tax and spend states I think that's a capital crime.

    Nope. He was executed. The coroner ruled it a homicide with the definition of: a homicide is a death caused by the intentional actions of another person or persons. And it was due to: compression of neck (choke hold), compression of chest and prone positioning during physical restraint by police.

    Rather sick to claim you know it all better.

    He was on the ground conscious and talking. Watching the video is fundamental. Not resisting arrest and not challenging the police is fundamental. Not selling untaxed contraband in front of stores whose owner obey the law and pay taxes is fundamental.
