The victim is left paralyzed or missing a limb, that person and his/her family could be screwed royally, but the perp gets 3 squares a day until he's released. Anyway, I guess in your mind you don't think pointing a gun at someone and pulling the trigger amounts to the intent to murder.
He wasn’t arrested for breaking into his own house. He was arrested for disorderly conduct for his behavior when a police officer responded to a 911 call

You'll never get it through the courts, a capital crime or murder is only resulted in when there is a homicide. You can only subject someone to capital punishment for a capital crime.

You are arguing that people are going to get drugs whether they're illegal or not, and making them illegal just creates an underground market and fuels gangs who sell drugs, so we should legalize and tax them instead. Right? Since many on the left are so eager to ban guns, how would your post here read if we substituted "guns" for "drugs"?
We have the history of mass shootings which we can apply to these proposed laws. It wouldn't have stopped them.

Getting accused of breaking into his own home made the guy a little edgy. Once he showed his ID the police should have simply apologized and left.
