Amber Guyger: Trial begins for ex-Dallas cop who killed neighbor in apartment mix-up

Here is an update on Amber, the Dallas cop who broke into a neighbors apartment and killed him. Her trial started this Monday and, hopefully, she will be convicted of murder. We can't have cops breaking into peoples homes and killing them and getting off on the excuse that they were tired from a long shift.

I think murder 1 is too far, depending on the facts of the case I'd push manslaughter.

Proving malice aforethought beyond a reasonable doubt is an extraordinary burden.

 

From the article, she was originally charged with manslaughter and they later upped the charge.. hmmmm

From the little I know, I also dont see a murder here.. maybe one of the most severe manslaughter cases/sentences though...

 

Perhaps we will find out why they upped the charge. As I recall they never established that they even knew each other.

 

To say it is murder is to say that she either:

1. Set this all up, observed his movements, deliberately entered the wrong room and shot him on a consciously false pretext then rang the cops.

2. Accidentally entered the wrong room, realised it was not hers, thought for a moment that she could probably get away with this, murdered him then called the police.

Based on the evidence we have been given neither of these two theories are supported, certainly not beyond a reasonable doubt.

Possibly the grand jury was presented with evidence supporting one of the above theories which we are not privy to. Also possible they got emotional and overstepped.

If the latter that's a real danger. Not only because someone not guilty of murder might go to jail for it, but also because someone guilty of manslaughter might not go to jail at all.

 

Her story was hooky from the beginning and if I recall, she had a continued conflict with this person. If that is the case, it's premeditated murder and she should charged to the fullest extent of the law.

I find this interesting because my wife and I moved into a new apartment complex a little over four months ago and she has made this mistake at least twice. We live on the second floor and have a decorative wreath on our front door. The apartment immediately below us does not have a wreath but does have one of those white, removable hooks on the front door where a wreath could be hung. At least twice now my wife has been surprised to find that her door key to our apartment didn't work till she realized she was at the wrong apartment. To consider the gal had just pulled down a 14 hour shift along with what was happening immediately in her personal life could make this a difficult case to get any kind of a conviction.

 

Why would she want to murder the man?

 

Apparently Amber had made several noise complaints about the victim, one even the day of the shooting there was a complaint of a smell of Mary J.

Don't disagree. I think that will be the prosecution using murder 1 as it appears to be premeditated.

 

BS. Amber is a cold-blooded killer in the first degree. As the prosecutor said, she was OK until her boyfriend told her that he wasn't coming to screw her. At that point she flew into a murderous rage and decided to kill the person who lived directly above her. In less than four minutes later the innocent victim was dying.

That BS about going to the victim's apartment by mistake is 100% BS. She ignored countless sensory clues that she was not going to her own apartment. If the prosecutor shows the signage indicating the floor it should convince a blind person that she is guilty of first degree murder. As he pointed out, she walked under the skylight and there is no skylight on her floor. You will also notice that none of the other cops who worked the entire day with her killed anyone that day because they were tired. She deserves the death penalty and I hope she gets it.

 

NOT guilty.

I don't know if it was premeditated or not, but it's probably not not murder.

 

So you're good with me walking into your house, thinking it's mine by honest mistake, and shooting you dead? Your dying words would be, "no worries, you had a long day..."?

 

I think she was a frightened girl in a mans profession

 

Well, sh!t does happen..

Nope, Not guilty..

 

It is amazing that so many people do not have a sense of right and wrong.

 

I don't think neither fatigue nor unaware of ones surrounding is a viable defense for killing someone. It may lessen the charge, but that would be all.

 

She deserves a LONG Prison Sentence.

 

We will find out soon enough, if the past is any indication, I doubt justice would be served. Not sure why they upped the charge, unless they have been in contact before, I don't why 2nd degree.
