SALT LAKE CITY – Some Black Lives Matter protesters in Salt Lake City could face up to life in prison if they’re convicted of splashing red paint and smashing windows during a protest, a potential punishment that stands out among demonstrators arrested around the country and one that critics say doesn’t fit the alleged crime.

The felony criminal mischief charges are more serious because they carry a gang enhancement. Prosecutors said Wednesday that’s justified because the protesters worked together to cause thousands of dollars in damage, but watchdogs called the use of the 1990s-era law troubling, especially in the context of criminal justice reform and minority communities.

“This is so far beyond just the enforcement of the law, it feels retaliatory,” said Madalena McNeil, who is facing a potential life sentence over felony criminal mischief and riot charges. Charging documents say she bought red paint at a Home Depot before the July 9 demonstration sparked by a fatal police shooting ruling. She later yelled at and shifted her weight as if to slam into police during the demonstration, charges state. “It’s really frustrating and scary ... I just feel so much concern for what this means for the right to protest in general.”

Don't destroy **** and you won't have that legal problem. The result of "peaceful protesting". Screw BLM. They do more harm to the cause of black communities than they do good.

I'm sure the left will have no problem with the hefty fines and serious penalties, because it'll be a bunch of right wing agitators that are charged.

That's the narrative, right? This is all being orchestrated by right wing extremists, and I'm sure all those leftist-city officials will be keen to unmask them, and prosecute them the the fullest extent of the law, and the progressives will cheer!

Means nothing for the right to protest because protesting wasn't even occurring. People, politicians, and media can cry "peaceful protest" all they want but when you're vandalizing property, breaking windows, setting fires, throwing rocks & IEDs, and looting Nikes, you're NOT a protester because you're NOT protesting.

 

These "enhanced penalties" are an absolute fantasy.

Assuming that the accused have relatively clean records and aren't on probation:

I would be surprised if any of the people did more that 90 Days in County Jail.

Most of these charges will get pled down to probation/fine + restitution/and possible county jail time.

These cases have been ridiculously (and absurdly) overcharged.

And, anybody who can read the Utah Statutes could blow these "enhanced charges" out of the water in 30 seconds.

 

Agreed. Nobody is going to lock up all those people for life. Beyond that, I think it would be appropriate for all of them to get community service and clean it all up.

If the rioters were to submit a guilty plea for the felony criminal mischief, pay a $10,000 fine, and 5 years probation and I'd agree that jail time could be taken off the table. This way they'd be subject to the consequences of being recognized as felons (/cough no vote), they'd experience a financial hit similar to that which their riotous movement has inflicted upon others, and they'd be on the hook to behave for the rest of this election season + the next less they face a lengthy prison term.

Oh and they can still go clean up the paint too.

 

And, if they cannot afford the $10,000 fine, they can "pay it off" with community service at the rate that incarcerated people are paid for their labor. I don't believe we need to put them in with hardened criminals (just to learn how to be more of a menace to society), BUT, they have to get the message that protests are fine, riots are not.

Of course, based on previous cases of this nature, they could just as easily enter a conditional plea to a felony (and then after a period of being effectively placed on probation) have it reduced to a misdemeanor.

 

Make them clean up the mess they've made.

 

And pay reparations.... I mean restitution

In Blue States they'd get VIP treatment at the polls - express pass all the way, son!

They should prosecute to the full extent of the law. It wasn't their property to deface. One of the properties was a private business and those people have to pay or spend time to clean up the mess. They will get off light but I hope they at least stick them with the bill for reparations and at least 6 months.

 

Presidents can only pardon for federal crimes. These are state crimes, and there isn't a snowball's chance in hell our Republican governor is going to pardon the commies for their vandalism.

 

I'm sure they won't get the maximum penalty for their crimes. Overcharging is a common prosecutor's tactic to get the defendants to plead guilty to lesser charges. Makes for an easy win for the prosecutor.

 

I know, I was just highlighting Biden's pandering to the far left democrat party. If they asked Biden would try and pardon Pol Pot.

 

I agree that vandalism should be punished. But a life sentence should be reserved for the worst crimes not vandalism. I'd say that some jail time and community service is a better punishment.

 

And make it like a student loan.......it's not dischargeable in bankruptcy so they have to pay till it's paid off.
