The very conservative SCOTUS in the early 1930s let almost all the New Deal to stand, making Roosevelt's court packing charade a nonstarter. So, why did SCOTUS let Roosevelt have his way? Because all it takes to change the number of Justices is simple legislation and a Presidential signature. Clearly, the Judiciary is the weakest branch of government, a truth SCOTUS understands and treads lightly.

Elections are the remedy for court stacking. The remedy for an ideological SCOTUS would be almost unreachable with your approach.
